About approval of Safety rules of work during execution of works in road economy
According to the Law of Ukraine "About labor protection", the Regulations on the State committee of Ukraine on industrial safety, labor protection and mountain supervision approved by the resolution of the Cabinet of Ministers of Ukraine of November 23, 2006 N 1640, I ORDER:
1. Approve Safety rules of work during execution of works in road economy (further - Rules) which are applied.
2. With entry into force of the order to consider not applied in the territory of Ukraine the Safety regulation and industrial hygiene in case of repair and content of railway track and constructions, approved by the Ministry of Railways of the USSR 08.09.88 N CPUs 4261.
3. To management of the organization of the state supervision for industrial safety on productions and objects of the increased danger (Krekhovetsky V. V.) in accordance with the established procedure to provide submission of this order on state registration in the Ministry of Justice of Ukraine.
4. To management of normative legal and legal support (Prokhorov V. V.) to enter Rules in the State register of regulatory legal acts concerning labor protection and to place them on the web page of Gosgorpromnadzor.
5. To chiefs of territorial administrations of Gosgorpromnadzor to take measures to studying of requirements of Rules by officials of the state inspections.
6. To the editor-in-chief of the Labor protection magazine Yakovenko M. G. to publish the order in the magazine.
7. To impose control over the implementation of this order on the vice-chairman of Gosgorpromnadzor Dolmatov O. I.

1.1. These Rules extend to the companies, organizations, the organizations (further - the companies) which perform works on content and tracks repair, constructions and devices of traveling facilities (further - traveling works).
1.2. Rules are obligatory for employees of the companies during execution of traveling works.
1.3. Rules establish safety requirements and sanitary and hygienic requirements to the equipment of workplaces of workers at the companies who perform traveling works.
1.4. Workers who had medical examination, according to requirements of the Regulations on medical examination, workers of certain categories approved by the order of the Ministry of Health of Ukraine of 31.03.94 of N 45, registered in the Ministry of Justice of Ukraine 21.06.94 for N136/345 are allowed to work in traveling facilities (further - Regulations on medical examination).
1.5. Persons, are younger than 18 years, are not allowed to work on the positions specified in Rules of technical railway operation of Ukraine, approved by the order of the Ministry of transport of Ukraine of 20.12.96 of N 411, registered in the Ministry of Justice of Ukraine 25.02.97 for N50/1854 (with changes) (further - TsRB/0004), directly connected with train service, and to the works connected with vibration influence, and also digging of deep and wet cuts, installation and disassembly in them of fixtures to works on repair of bridge and tunnel constructions, cleaning of railroad switches, welding наплавочных works and works with poisonous chemicals and other works according to the List of hard work and works with harmful and dangerous working conditions on which application of the work of minors approved by the order of the Ministry of Health of Ukraine of 31.03.94 of N 46, registered in the Ministry of Justice of Ukraine 28.07.94 for N176/385 is forbidden.
1.6. Women are not allowed to performance of works, the hard work and works with harmful and dangerous working conditions noted in the List on which application of work of women is forbidden, approved by the order of the Ministry of Health of Ukraine of 29.12.93 of N 256, registered in the Ministry of Justice of Ukraine 30.03.94 for N51/260, and also to lifting and cargo transfer in case of alternation with other work which weight exceeds - 10 kg, and is permanent during working shift - 7 kg, according to Limit rates of lifting and movement of the heavy things by women approved by the order of the Ministry of Health of Ukraine of 10.12.93 of N 241, registered in the Ministry of Justice of Ukraine 22.12.93 for N194.
1.7. Studying and examination concerning labor protection, and also procedure for the admission to independent work of employees of traveling facilities is carried out according to requirements of the Standard regulations on procedure for carrying out the training and examination concerning labor protection approved by Gosnadzorokhrantrud's order of 26.01.2005 of N 15, registered in the Ministry of Justice of Ukraine 15.02.2005 for N231/10511 (further - NPAOT 0.00-4.12-05), and concerning fire safety according to requirements of the Standard regulations on instructing, special training and examinations concerning fire safety at the companies, in organizations and the organizations of Ukraine, the Ministry of Ukraine approved by the order concerning emergency situations and for protection of the population against effects of the Chernobyl catastrophic crash of 29.09.2003 N 368, registered in the Ministry of Justice of Ukraine 11.12.2003 for N1148/8469 (further - NAPB B.02.005-2003).
1.8. Employees of road economy are provided free of charge with overalls, special footwear and other individual protection equipment according to requirements of the Regulations on procedure for the providing workers with special clothes, special footwear and other individual protection equipment approved by Gosnadzorokhrantrud's order of Ukraine of 29.10.96 of N 170, registered in the Ministry of Justice of Ukraine 18.11.96 for N667/1692 (further - NPAOT 0.00-4.26-96), and on the regulations established according to Regulations of free issue of special clothes, special footwear and other individual protection equipment to workers of rail transport of Ukraine approved by Gosnadzorokhrantrud's order of Ukraine of 21.01.2004 of N 12, registered in the Ministry of Justice of Ukraine 06.02.2004 for N169/8768 (further - NPAOT 60.1-3.01.04).
1.9. During execution of works on railway track all workers shall be dressed in working overalls of orange color with light-relecting strips on trunk, hands and legs.
1.10. The victim or the worker who found it or other person witness of accident shall report about each accident immediately to the direct works manager or other authorized person of the company and take measures for rendering necessary assistance to the victim according to Procedure for investigation and accounting of accidents, occupational diseases and accidents on production approved by the resolution of the Cabinet of Ministers of 25.08.2004 of N1112.
2. Safety requirements during execution of traveling works
2.1.1. All works which are connected with construction as upgrade, demontazhy, shall be carried out by repair and reconstruction of way, constructions and devices of traveling facilities according to the approved engineering procedures which are regulated by normative and technical documents.
Process charts and other documents which regulate engineering procedures shall contain safety requirements during their accomplishment.
2.1.2. Employees of traveling facilities who perform works on servicing and operation of electroinstallations and the electric tool shall have group on electrical safety and certificates according to Rules of safe operation of electroinstallations of the consumers approved by Gosnadzorokhrantrud's order of Ukraine of 09.01.98 of N 4, registered in the Ministry of Justice of Ukraine 10.02.98 for N93/2533 (further - NPAOT 40.1-1.21-98).
The examination of electrotechnical personnel and assignment of the corresponding group on electrical safety shall be held according to the procedure, the established NPAOT 40.1-1.21-98.
2.1.3. Venues of traveling works shall be protected and have precautionary signs.
The prevention in connection with accomplishment of traveling works according to normative and technical acts on train service safety is issued to locomotive crew of each train.
2.1.4. In case of concurrent work in volume of one engineering procedure on stage of several economic trains all of them irrespective of accessory submit to one responsible person to whom accomplishment of these obligations (dalsherukovoditel of works) is assigned.
2.2. Safety requirements in travel time of workers to the place of performance of works and during return to the place of collection
2.2.1. Prior to following of workers to the place of performance of works the works manager shall check availability of alarm devices and protection devices, be convinced that the request for issue of preventions to locomotive crews of trains is accepted to accomplishment.
2.2.2. Follow from the place of collection for work and it is allowed return only sideways from track or roadside of road bed under the leadership of specially nominated person.
Following to the place of performance of works and return within the station shall is performed according to the scheme of office passes and the approved instruction on the organization of works and providing security measures during execution of traveling works.
2.2.3. Workers shall follow, paying attention to railway vehicles which move, and also on limiting columns, trays, ditches and other obstacles.
2.2.4. During transportation of the traveling tool and materials on traveling cars, two-wheeled monorail or single-axle dollies for maintenance them mounters of way (at least two), and also signalmen ahead and behind with figurative or manual red signals at distance at least 50 m from above-mentioned carts are appointed; other workers go on roadsides of road bed.

Before group there shall be signalman who protects group with stop signals; in the conditions of insufficient visibility (in abrupt curves, deep dredging, in the woody area, in the presence of buildings, and also in night-time, fog, snowstorm and other cases) the works manager shall appoint two signalmen, one of whom goes ahead, and another - behind group at distance of visual communication, but so that the train which comes nearer was we see to it at distance not closer than 500 m from group and in time gives horn signal of approach of the train.
Signalmen shall go with the developed red tags (in the night from lamps with red fire) and to protect employee group so far it will not descend from way.
2.2.6. On the multiple-track sites and stages equipped with bilateral automatic lock-out for determination of the direction of train service workers are guided on signals of traffic lights.
2.3. Safety requirements during work on railway tracks
2.3.1. Prior to works in the cases provided by normative and technical documents on safety of movement and these Rules necessary signals, alarm signs "C" (about giving of whistle) and signalmen shall be exposed, and also preventions on trains are issued.
For the warning of workers of approach of the train on the next track during execution of traveling works on one track two-or the multiple-track site irrespective of the fact which signals protect the place of performance of works, on the next track alarm signs "C" (about giving of whistle), except works during execution of which the next track is protected with stop signals are established.
2.3.2. Before works in night-time, during fog, snowstorm, etc. when visibility less than 800 m, the works manager takes additional security measures:
submits the application for issue of warnings to locomotive crews of special vigilance and about giving of announcing signals in case of approach to work location;
exposes signalmen on both sides of work location for the notice of workers on approach of the train;
plans works so that the scope of work on one head of crew was no more than 50 m;
at stations and stages automatic means of the notification shall be applied.
2.3.3. Before performance of works in the narrowed places where on both sides of way high platforms are located, buildings, fences or abrupt slopes of dredging, and also on bridges, in tunnels and snow trenches for safety of workers adequate measures are taken.
2.3.4. During work on railway track the works manager shall:
2.3.4.1. Specify to workers the place sideways from track where they shall descend from way to time of the omission of the train.
2.3.4.2. Take measures that in zone of performance of works there were no strangers.
2.3.4.3. During approach of the train with speed up to 141 km/h to send the command about withdrawal of workers from way aside so that in case of distance to the train at least than 400 m they did not remain on track.
Withdrawal of workers from way is performed on such distance from extreme rail: in case of approach of the train - at least 2 m; in operating time of the tracklayer (except crew which services it), electroballasting machine, the harvester, the relsoshlifovalny train and other machines of heavy type - on 5 m; in operating time of traveling strugan of 10 m; in operating time of the machines equipped with shchebneochistny devices, double-track and rotor snowplows - on 5 m aside, opposite to emissions of snow, ice or zasoritel; in operating time of single-track snowplows - on 25 m.
2.3.4.4. In places where clearing of snow is executed by trenches, by the time of approach of the train to take away workers in niches.
2.3.4.5. Warn workers that at stations they passed ways at right angle, previously having convinced that on the ways which they pass, there are no railway vehicles which come nearer (locomotives, cars, section cars).
2.3.4.6. Warn that upon transition of way and during execution of works near railroad switches and crosspieces workers did not go into rails, did not become between frame rails and funnymen or in trenches on the railroad switch and for the end of steel concrete cross tie with bias.
2.3.4.7. Warn workers that is not allowed perebegany ways before moving structure which comes nearer, and during bypass of cars which stand on ways, crossing of this way closer than 5 m from the extreme car is not allowed; pass between cars is allowed in case of distance between them at least 10 m.
2.3.4.8. Warn workers that upon transition in ways before the motionless train its reduction in movement, and also about train service on the next track is possible; during exit to way because of arrow posts and other buildings which worsen visibility of way that previously were convinced of lack of the train which moves on it.
2.3.4.9. Watch that in operating time on centralized shooters between the taken-away funnyman and frame rail or between the mobile core and usoviky against drafts of the electric drive the wooden insert was pledged.
2.3.4.10. Watch that work on cleaning of arrows was performed by group at least two people, one of whom fulfills duties of the signalman and observes train service.
2.3.4.11. In case of approach of thunder-storm, dust storm, hurricane the safe omission of trains shall be provided and be organized the shelter of workers whenever possible in the enclosed space.
