About rescue services

(as amended on 28-06-2013)

This Law determines the organizational, legal and economic principles of creation and activities of rescue services, obligations, the rights, guarantees of social protection and responsibility of rescuers, and also questions of international cooperation in the field of liquidation of emergency situations.

Section I. GENERAL PROVISIONS

Article 1. Determination of terms

In this Law the stated below terms are used in the following value:

emergency situation - violation of normal living conditions and activities of people in the territory or object on it or on water object (further - objects and the territories), caused by accident, catastrophic crash, natural disaster or other dangerous event which entailed (can entail) death of people and/or considerable material losses;

accident - dangerous incident of technogenic nature which entailed death of people or creates on object or the territory threat of life and to human health and attracts destruction of buildings, constructions, the equipment and vehicles, violation of production or transport process or causes environmental damage;

catastrophic crash - accident large in terms of the scope of or other incident which entailed serious, tragic consequences;

zone of emergency situation - the territory where there was emergency situation;

water object - the landscape object created by the nature or created artificially where waters are concentrated (the lake, the river, the sea, water storage basin, the channel, etc.);

rescue service - set organizationally the joint governing bodies, forces and means intended for the solution of tasks according to the prevention and liquidation of emergency situations of technogenic and natural nature and their separate effects, carrying out search, rescue and other urgent works;

professional rescue service rescue service which staff works at constant, and rescuers of this structure - also on the professional basis providing special physical and psychological training of staff;

the special (militarized) rescue sluzhbaprofessionalny rescue service founded on the principles of one-man management, centralization of management, authorized discipline, the personal liability;

specialized rescue service the professional rescue service having the prepared and equipped staff for liquidation of separate classes and subclasses of emergency situations (suppression of gas fountains, provision of the emergency medical care by the victim, diving works, etc.) and the appropriate rescue means;

rescue unit - the structural division of rescue service intended for carrying out wrecking;

rescue services public the organizatsiyavariyno-rescue services created by associations and the unions of associations of citizens;

auxiliary division to rescue sluzhbystrukturnoa the division of rescue service intended for ensuring activities for accomplishment of the tasks assigned to it;

the rescuer - the person having the corresponding special preparation, certified on capability to carrying out wrecking and directly taking in them the part having special physical and psychological training and which is responsible for its maintenance;

rescue means - the technical means of special purpose, scientific and technical products and other objects of intellectual property right (the means of communication, the equipment, the equipment, equipment, materials, video, film, photographic materials on technologies of carrying out wrecking, software products and databases and other means) used when carrying out wrecking;

wrecking - the works sent to search, rescuing and protection of people (including rendering emergency medical service to them), and also material and cultural values and environment protection in case of emergency situations, requiring employees engagement, having special preparation, individual protection equipment and equipment;

medical support of activities of rescue services - complex of the actions aimed at providing victims with emergency medical service owing to emergency situation in the center of event and during their evacuation in medical institutions, and also, if necessary, to rescuers, preserving optimum working capacity and social activity of rescuers, material equipment by medical means of rescue services (forming).

In the professional rescue service special (militarized) rescue service, specialized rescue service, rescue units special physical and psychological training of staff is entered.

Article 2. The legislation in the field of rescue case

The relations in the field of rescue case are governed by this Law, the laws of Ukraine "About Civil defense", "About labor protection", the Resolution of the Verkhovna Rada of Ukraine of February 22, 1996 "About approval of the Regulations on reserve fund of the Cabinet of Ministers of Ukraine" and other regulatory legal acts.

Article 3. Tasks and functions of rescue services

The main objectives of rescue services are:

carrying out in case of emergency situations on objects and the territories of wrecking;

liquidation of emergency situations and their separate effects;

performance of works according to the prevention of origin and minimization of effects of emergency situations of technogenic and natural nature and on protection from them of the population and the territories;

protection of the surrounding environment and localization of zone of influence of the harmful and dangerous factors arising during accidents and catastrophic crashes.

According to the main functions of rescue services assigned to them by tasks are:

ensuring readiness of the governing bodies, forces and means to actions to destination;
