About modification of some legal acts of Ukraine concerning law enforcement and transparency in activities of local government bodies

The Verkhovna Rada of Ukraine decides:

I. Make changes to such legal acts of Ukraine:

1. In the Code of administrative legal proceedings of Ukraine (The sheet of the Verkhovna Rada of Ukraine, 2017, No. 48, the Art. 436):

1) part the second Article 150 to add with Item 3 following of content:

"3) signs of illegality of the act of local government body are obvious and rejection of such measures can significantly complicate or make impossible execution of the judgment about recovery of provision which existed before adoption of such act (on cases on law enforcement of acts of local government bodies)";

Part one of Article 238 to add 2) with Item 9 of the following content:

"9) on appeal of acts of local government bodies on cases on law enforcement of acts of local government bodies if the court establishes availability of the appropriate authority on implementation of the state supervision (control) in the specified sphere provided by the law in other public authorities";

Article 264 to add 3) with part thirteen of the following content:

"13. Rules of this Article do not extend to hearing of cases on law enforcement of acts of local government bodies, stipulated in Article 289-11 of this Code";

To replace 4) in part one of article 268 of figure "285-289" with figures "285-289, 289-11";

To replace 5) in part one of article 269 of figure "285-289" with figures "285-289, 289-11";

In paragraph one of part one of article 271 of figure "289-5" to replace 6) with figures "289-5, 289-11";

7) in Article 272:

in part one of figure "286-288" to replace with figures "286-288, 289-11";

in part two of figure "289-4" to replace with figures "289-4, 289-11";

in parts four of figure and the word "288 and 289-4" to replace with figures "288, 289-4, 289-11";
