1. Bring in the order of the Minister of Finance of the Republic of Kazakhstan of November 30, 2021 No. 1253 "About approval of Rules of implementation of purchases by certain subjects of the quasi-public sector, except for National welfare fund and the organizations of National welfare fund" (it is registered in the Register of state registration of regulatory legal acts at No. 25488) the following changes and amendments:

in Rules of implementation of purchases by certain subjects of the quasi-public sector, except for National welfare fund and the organizations of National welfare fund approved by the specified order:

add Item 2 with subitem 19-1 of the following content:

"19-1) agreement on "turnkey" construction – the agreement which subject are the complex works on asset construction and its introduction in operation including accomplishment project, prospecting, construction (new construction, reconstruction), and also accompanying the specified works delivery of goods and rendering services, except for conducting complex non-departmental examination of projects and services of technical supervision;";

state Item 18 in the following edition:

"18. Procurements are conducted by the following methods:

1) tender;

2) auction;

3) request of price offers;

4) from one source;

5) it is excluded by the order of the deputy. The Minister of Finance of RK of 07.08.2024 No. 523 (becomes effective from 01:01. 2025);

6) by means of electronic shop.

1) for fitting, upgrade and retrofitting of the capital (installed) equipment, and also the established software (licensed software);

2) it is excluded by the order of the deputy. The Minister of Finance of RK of 18.07.2022 No. 729 (becomes effective after ten calendar days after day of its first official publication);

3) for repair and (or) maintenance of the goods (equipment) which are available for the customer.";

"87. Tender security on participation in the tender is brought in the amount of one percent from the amount allocated for purchase of goods, works, services.

In case of participation in the tender by method of the tender for "turnkey" construction the potential supplier brings tender security in the amount of three percent from the amount allocated for the tender.

In case of participation in the tender for several lots the potential supplier provides tender security on participation in the tender for each lot separately.

Tender security compliance on participation in the tender is determined by the web portal automatically in case of submission by the potential supplier of the application for participation in the tender.";

"Paragraph 16. Procedure for the organization of implementation of purchases by method of the tender of "turnkey" construction

155-9. Procurements by method of the tender for "turnkey" construction are conducted in case of projects implementation technically of difficult buildings and constructions, including objects of transport and engineering infrastructure, based on the feasibility statement or the settlement estimated cost of construction determined by the enlarged indicators of the estimated cost of the structural elements developed according to the legislation on architectural, town-planning and construction activities.

155-10. The tender for works on "turnkey" construction includes carrying out purchases as a part of single lot for complex works in the field of construction according to the legislation on architectural, town-planning and construction activities.

155-11. The following qualification requirements are imposed to the potential suppliers participating in purchases by method of the tender for "turnkey" construction:

1) availability of permission (license) on implementation of project activities and installation and construction works in the field of architecture, town planning and construction.

2) to be financially steady and not to have tax debt according to the procedure, determined by these rules.

155-12. When implementing purchases the method of the tender for "turnkey" construction applies the following not price criteria influencing tender results:

1) availability at the potential supplier of work experience under the executed agreements, the amount of installation and construction works which at least 50 (fifty) percent from the amount allocated for implementation of purchases make.

If the potential supplier has work experience, 1 (one) point for each realized such object is appropriated to such potential supplier, the total number of points in the tender of this criterion does not exceed 5 (five) points.

At the same time, the work experience in quality of subcontractor is not considered;

2) the obligation on providing the share of local content exceeding the average value on industry (specified in design assignment).

If the potential supplier as a part of the application for participation in the tender assumes obligation on providing the share of local content exceeding the average value on industry (specified in design assignment), 1 (one) point for each additional 10 (ten) percent of local content is appropriated to such potential supplier;

3) quality assurance on construction object:

- on the main designs;

- on engineering networks;

- on the equipment;

If the potential supplier as a part of the application for participation in the tender agrees to quality assurance on construction object, is appropriated to such potential supplier:

- for guarantee for the main designs of 0,1 (zero whole the one tenth) point for every year of guarantee, the total number of points in the tender of this criterion does not exceed 5 (five) points;

- on engineering networks 0, ((zero whole the one tenth) for every year of guarantee, the total number of points in the tender of this criterion does not exceed 2 (two) points;
