RESOLUTION OF COUNCIL OF MINISTERS OF THE REPUBLIC OF BELARUS

About change of the resolution of Council of Ministers of the Republic of Belarus of February 20, 2007 No. 223

Based on article 21 of the Law of the Republic of Belarus of July 5, 2004 "About architectural, town-planning and construction activities in the Republic of Belarus" the Council of Ministers of the Republic of Belarus DECIDES: No. 300-Z

1. Bring in the resolution of Council of Ministers of the Republic of Belarus of February 20, 2007 No. 223 "About some measures for enhancement of architectural and construction activities" the following changes:

1.1. in Regulations on the procedure for preparation and issue of allowing documentation on construction of facilities approved by this resolution:

Item 2 paragraph two after words "to improvement of the built-up parcel of land," to add with words "to the address with waste,";

in item 4:

to exclude the paragraph of the sixth of subitem 4.2-1;

state subitem 4.4.1 in the following edition:

"4.4.1. not used objects – the decision of executive committee on permission of asset demolition with indication of in such solution of need of development of the project documentation, about, method of demolition of not used object, procedure for the treatment of the materials and waste which are formed in case of demolition of not used object, and procedure for recovery of fertility of the broken lands and their involvement in economic circulation;";

in Item 5:

add part one with the words "in forms according to appendices 1-1-1-11";

in part two to replace figure "8" with figure "9";

after part three to add Item with parts of the following content:

"The technical requirements and specifications provided in the established forms in case of their observance do not require additional confirmation of their accomplishment in any form (putting down of signature stamp of approval, receipt of the written confirmation of consideration, issue of the conclusion about consideration and other).

If by consideration of request about provision of technical requirements and specifications it is determined that the asset construction on the considered parcel of land contradicts requirements of acts of the legislation, state bodies (organizations), authorized to issue technical requirements and specifications, refuse issue of technical requirements and specifications.";

in Item 6:

after part three to add Item with part of the following content:

"In case of the expiration of the terms established in allowing documentation on construction, repeated issue of allowing documentation is performed according to the procedure, established by this Provision.";

in word part four" (number and approval date of architectural and planning task (the town-planning passport), number and date of the act of the choice of the location of the parcel of land with date of its approval (in the presence)" shall be replaced with words "(details of documents)";

in part two of Item 7 of the word "Form" and "is established" to replace respectively with the words "Forms" and "and schemes of placement of object are established";

in part four of Item 8 of the word "within the ministerial procedure providing possibility of modification of earlier issued allowing documentation on construction object" shall be replaced with words "according to the legislation on ministerial procedures";

parts one of Item 10 to add the first offer of the paragraph of third with words ", with appendix to request of the documents specified in paragraphs second and third to part two of Item 9 of this provision";

the first offer of the paragraph of third Item 16 to add with words ", with appendix to request of the documents specified in paragraphs second and third to part one of Item 14 of this provision";

in Item 19:

the second to add part with the paragraph of the following content:

"the document confirming balance sheet accessory or the statement from it, except for objects, information on which contains in the single state register of real estate, the rights to it and transactions with it.";

to add paragraph two of part three with words ", except for objects, information on which does not contain in the single state register of real estate, the rights to it and transactions with it";

the first offer of part one of Item 24 to add with words ", with appendix to request of the documents specified in paragraphs second and third to part two of Item 19 of this provision";

the first offer of Item 28 to add with words ", with appendix to request of the documents specified in paragraphs second and third to part one of Item 26 of this provision";

the first offer of Item 36 to add with words ", with appendix to request of the documents specified in paragraphs second and third to Item part one 34 this provision";

in appendix 1 to this Provision:

state Item 3 in the following edition:

"3. The bodies and organizations exercising the state sanitary inspection (on objects according to the list approved by the Ministry of Health).";

state Item 6 in the following edition:

"6. State supervision bodies in the field of protection of the population and the territories against emergency situations of natural and technogenic nature and civil defense (on objects according to the list approved by the Ministry of Emergency Situations).";

add the Provision with appendices 1-1-1-11 and 9 (are applied);

to be reworded as follows appendix 2 to this Provision it (is applied);

1.2. in Regulations on the chief architect of area, the city, the area, area in the city approved by this resolution:

to exclude from item 4 of the word "and project and estimate";

9, of subitem 17.8 of Item 17, of subitem 22.5 of Item 22 of the word "and architectural projects" to exclude from subitem 9.9 of Item;

from subitem 27.4 of Item 27 of the word of "construction objects" to exclude.

2. This resolution becomes effective in 7 days after its official publication.
