About modification of some orders of the Government (about project management of the state capital investments)

Based on article 41 of the Law No. 181/2014 on public finance and budget and tax responsibility (The official monitor of the Republic of Moldova, 2014, Art. No. 223-230, 519), with subsequent changes, DECIDES: the Government

1. In the Regulations on projects of the state capital investments approved by the Order of the Government No. 684/2022 (Official monitor of the Republic of Moldova, 2022, Art. No. 326-333, 787), with subsequent changes, to make the following changes:

1.1. in Item 11 the word "budget" shall be replaced with words "the sphere of the state capital investments";

1.2. 5) of Item 20 to state the subitem in the following edition:

"5) offers on the new projects providing implementation of the types of activity included in appendix No. 1 or 2 to the Law No. 86/2014 on environmental impact assessment are followed without fail by the ecological allowing acts issued by the Agency of the environment according to the specified law.

Offers on the new projects which are not providing implementation of the types of activity included in appendix No. 1 or 2 to the Law No. 86/2014 on environmental impact assessment are represented without fail to the Ministry of the environment for consideration and issue of the conclusion about climatic effects and vulnerabilities of the project only in the presence of the enclosed written notice issued by the Agency of the environment according to part provisions (71) article 10 of the specified law.";

1.3. state Item 21 in the following edition:

"21. TsOPU initiating the project bears responsibility for:

1) preparation of the technical documentation relating to the project (including the feasibility statement);

2) receipt of the ecological allowing act issued by the Agency of the environment in case of the types of activity included in appendix No. 1 or 2 to the Law No. 86/2014 on environmental impact assessment;
