1. In the resolution of the Plenum of the Supreme Court and the Plenum of the Supreme Economic Court of the Republic of Uzbekistan "About some questions of application of the regulations of the civil legislation on ensuring obligation fulfillment following from credit agreements" No. 13/150 of December 22, 2006:
add item 4 with the fourth - the seventh paragraphs of the following content:
"According to Article 746-1 of the Civil code in case of early collection of the credit judicially if other procedure is not provided by the agreement, the creditor at first takes a legal action behind collection of part of the debt which is not returned at the scheduled time. At the same time if the borrower did not repay overdue debt completely, the creditor has the right to take a legal action with the requirement about early return of all remained credit amount.
With respect thereto, by consideration of claims for early collection of the rest of the credit courts shall study terms of the contract and if the agreement does not provide other, to establish whether the creditor at first appealed to court with the requirement about collection of overdue part of debt.
If it is determined that the creditor early did not address with the recovery suit of overdue part of debt, courts should discuss at first only question of collection of overdue part of credit debt, in satisfaction of part of the recovery suit of the credit on which the term of return did not come to refuse.
