About modification and amendments in the resolution of the Plenum of the Supreme Court of the Republic of Uzbekistan of February 3, 2006 No. 1 "About practice of appointment of criminal penalty as courts"

Bring in the Resolution of the Plenum of the Supreme Court of the Republic of Uzbekistan of February 3, 2006 No. 1 "About practice of appointment of criminal penalty as courts" the following changes and amendments:

1. Preamble:

add with the second paragraph of the following content:

"According to the requirement of article 20 of the Constitution of the Republic of Uzbekistan the measures of legal impact applied to person shall be based on the principle of proportionality and to be sufficient for goal achievement, provided by the laws.";

5. Add Item 9 with the fourth and fifth paragraphs of the following content:

"In case of the solution of question of recognition of person by especially dangerous recidivist also its criminal record on sentences of courts of other states can be considered.

At the same time courts need to check whether it is provided criminal prosecution for the crime specified in the court verdict of other state as well in the Criminal code of the Republic of Uzbekistan, and also compliance to the criteria established in Article 34 of this Code for recognition of person by especially dangerous recidivist.";
