About introduction of amendments to the Code of administrative legal proceedings of the Russian Federation

Bring in the Code of administrative legal proceedings of the Russian Federation (The Russian Federation Code, 2015, No. 10, Art. 1391; 2018, No. 49, Art. 7523) following changes:

1) part 11 of Article 49 to recognize invalid;

Article 77 to add 2) with parts 5.1 - 5.3 following of content:

"5.1. About purpose of examination or about variation of the petition for purpose of examination the court takes out determination.

5.2. If the petition for purpose of examination is declared by the party (parties) or other persons participating in case, the court takes out determination about purpose of examination after introduction by person of the sums of money which are subject to payment to experts who declared the corresponding petition into the account specified regarding 1 article 109 of this Code, except as specified, stipulated in Article 107 and parts 2 and 3 of article 109 of this Code.

5.3. If the sums of money which are subject to payment to experts were not granted on the time established by court into the account specified regarding 1 article 109 of this Code, the court has the right to reject the petition for purpose of examination. If case cannot be considered and the decision is made based on other evidence produced by the parties, the court has the right to appoint examination on the initiative.";

3) parts 1 and 4 of Article 78 to recognize invalid;

4) regarding 1 Article 109 of the word "the corresponding request" shall be replaced with words "the corresponding petition", shall be replaced with words the words "such request is declared" "the corresponding petition is declared";

5) in Article 110:

a) in the name of the word to "witnesses and translators" shall be replaced with words to "witnesses, translators and experts";

b) add with part 3 following of content:
