Article 13 to add 1) with Items 7 and 8 of the following content:
"7. Penalty, stipulated in Item the 6th this Article, is not subject to collection if the manufacturer (the contractor, the seller, authorized organization or the authorized individual entrepreneur, the importer) in voluntary procedure did not meet consumer requirement because of the consumer, including in case of evasion of the consumer from making of the actions provided by this Law or such non-execution of obligations by it as a result of which the manufacturer (the contractor, the seller, authorized organization or the authorized individual entrepreneur, the importer) was deprived of opportunity in voluntary procedure to meet consumer requirements.
The penalty, stipulated in Item the 6th this Article, is also not subject to collection if the manufacturer (the contractor, the seller, authorized organization or the authorized individual entrepreneur, the importer) did not perform or out of time fulfilled the obligations to the consumer established by this Law owing to violation by the partner of obligations on delivery of goods (performance of works, rendering the services) necessary for obligation fulfillment before the consumer, except for case if the manufacturer (the contractor, the seller, authorized organization or the authorized individual entrepreneur, the importer) acted from bad faith or unreasonably in case of the choice of such partner.
