About modification of some regulatory legal acts of the National Bank of Ukraine concerning requirements to structure of property of suppliers of financial services

According to Articles 7, of 15, of 17, of 33, 33-1, 55-1, 56 Laws of Ukraine "About the National Bank of Ukraine", Articles 21, of 22, 40 Laws of Ukraine "About financial services and finance companies", article 18 of the Law of Ukraine "About insurance", Articles 5, 22 Laws of Ukraine "About consumer crediting", Articles 77, "About payment services", for the purpose of establishment of requirements to structure of property of suppliers of financial services, the collection companies, the collector companies, the companies carriers, the companies on processing of cash, suppliers of financial payment services, suppliers of non-financial payment services, legal entities who address to the National Bank of Ukraine for obtaining авторизации/лицензирования/регистрации/аккредитации activities and receipt of the status of the specified subjects the Board of the National Bank of Ukraine decides 78 Laws of Ukraine:

1. In heading and Item 1 of the resolution of Board of the National Bank of Ukraine of April 14, 2021 "About approval of the Regulations on requirements to structure of property of suppliers of financial services of" the word "suppliers of financial services" shall be replaced with words No. 30 "in the market of financial and payment services".

2. Make changes to Regulations on requirements to structure of property of suppliers of financial services, the Board of the National Bank of Ukraine approved by the resolution of April 14, 2021 No. 30 (with changes) (further - the Provision), having been reworded as follows it which is applied.

3. The National Bank of Ukraine (further - National Bank) considers documents which were filed by the supplier of financial services, the payment service provider, the collection company, the collector company, the company carrier, the company on processing of cash to National Bank before entry into force of this resolution according to the Provision and on which the National Bank did not make the decision, without the changes made by this resolution.

4. The decision by results of consideration of documents which were filed to National Bank according to Item 3 of this resolution accepts:

1) Committee on questions of supervision and regulation of activities of banks, oversight of payment infrastructure - concerning payment service providers;

2) Committee on questions of supervision and regulation of activities of the markets of non-bank financial services - rather collection companies, suppliers of financial services which have no right to provision of payment services;

3) Board of National Bank - concerning the collector companies, the companies carriers, the companies on processing of cash.

5. The board of National Bank till December 15, 2025 accepts:

1) the decision provided in Item 64 of the Section V of the Provision concerning the service providers determined in subitems 3-5 of Item 66 of the Section V of the Provision;

2) the decisions provided in Items 78 and 82 of the Section VII of the Provision concerning the service providers determined in subitems 3-5 of Item 85 of the Section VII of the Provision.

6. To department of methodology of regulation of activities of non-bank financial institutions (Sergey Savchuk) after official publication to inform suppliers of financial services, the collection companies, the collector companies, the companies carriers, the companies on processing of cash on adoption of this resolution.

7. The resolution becomes effective from the date of, its official publication following behind day.
