About introduction of amendments to the Town-planning and construction code No. 434/2023

The Parliament adopts this organic law.

Art. I. - In the Town-planning and construction code No. 434/2023 (Official monitor of the Republic of Moldova, 2024, Art. No. 41-44, 61), with subsequent changes, to make the following changes:

1. Part (Article 44 to state 1) in the following edition:

"(1) the Detailed town-planning plan represents documentation in which conditions of placement and construction are established:

- on certain parcel of land of one or several constructions of special purpose, for the territory within the settlement;

- on certain parcel of land or several adjacent parcels of land of one or several constructions, for the territory behind line of the settlement in the cases provided by part (31).".

2. In Article 130:

to state the name of Article in the following edition:

"Article 130. Approval/coordination of the project documentation by issuers of the conclusions on connection and/or spetsializiro-bathing architectural and town-planning structures of bodies of local public authority";

add Article with part (10-1) following contents:

"(10-1) Project documentation or specifications in the cases provided by part (11) Articles 150, in the part concerning Items g) and h) parts (1), for works on running repair of highways and the construction works on arrangement of sidewalks developed according to the technical regulations regulating distance across and verticals are not subject to additional approval of owners of engineering networks / managing engineering networks which are located in the corresponding zone. In 10 days prior to works the builder notifies system operators / managing directors by engineering networks on the beginning of works with appendix to the notification of the project documentation or specifications.".

3. In the prolog of part (Article 150 of the word "The Checked Project Documentation" shall be replaced with words 6) "Project documentation", "structure in the field of architecture" shall be replaced with words words "architectural and town-planning structure".
