Due to the change of the civil procedural legislation and within inventory count of resolutions of the Plenum of the Supreme Court of the Kyrgyz Republic, being guided by Item 7 of article 18 of the constitutional Law of the Kyrgyz Republic "About the Supreme Court of the Kyrgyz Republic and local courts", item 3.2 of the Supreme court rule of the Kyrgyz Republic, the Plenum of the Supreme Court of the Kyrgyz Republic decides:
1. Bring in the resolution of the Plenum of the Supreme Court of the Kyrgyz Republic "About preparation of cases for legal proceedings" of March 30, 2018 No. 8 the following change:
- Item 9.1. state resolutions in the following edition:
"The parties are informed on time and the place of preliminary judicial session by one of the following methods: by means of the SMS message, service of the guaranteed delivery of messages, the telephone message, the telegram, on the fax connection, e-mail or other similar forms of telecommunications allowing to fix the direction fact court and receipts of the corresponding notice by the addressee. In case of lack of possibility of use of the above-stated methods, the notice is performed by the legal notification. Notices and the agenda go to the parties the registered mail with the assurance of receipt to the addressee (gl.12 the Art. 128 GPK of the KR).
Absence of persons participating in case does not interfere with consideration of questions on preparation of case in preliminary judicial session. The forced drive of the defendant is not allowed".
2. The resolution becomes effective according to the procedure and the terms established by the Supreme court rule of the Kyrgyz Republic.
