About differentiation of jurisdiction of cases between general and economic courts
For the purpose of realization of the constitutional guarantees for judicial protection of the rights and legitimate interests of citizens, legal entities and the state, the correct and uniform application of the current legislation by general and economic courts and prevention of cases of unreasonable refusal in adoption of statements the Plenum of the Supreme Court of the Republic of Belarus and the Plenum of Supreme Economic Court of the Republic of Belarus
decide:
1. According to Article 10 of the Civil code of the Republic of Belarus protection of the violated or disputed civil laws is performed by general court, economic court, reference tribunal according to the jurisdiction established by the procedural legislation (The code of civil procedure of the Republic of Belarus and the Economic Procedure Code of the Republic of Belarus, further respectively - GPK and HPK, other legal acts), and in stipulated by the legislation cases - according to the agreement.
Protection of the civil laws in administrative (extrajudicial) procedure is performed only in cases, stipulated by the legislation. The decision made administratively can be appealed in court - general or economic - according to their competence.
