About modification of Item 3.2 of the Regulations on procedure of phytosanitary quarantine control (supervision) on customs area of the Eurasian Economic Union

According to Item 18 of the Protocol on application of sanitary, veterinary and sanitary and quarantine phytosanitary measures, emergency phytosanitary measures (appendix No. 12 to the Agreement on the Eurasian Economic Union of May 29, 2014) and Item 50 of appendix No. 1 to the Regulations of work of the Eurasian economic commission approved by the Decision of the Supreme Eurasian economic council of December 23, 2014 No. 98, Council of the Eurasian economic commission DECIDED:

1. Item 3.2 of the Regulations on procedure of phytosanitary quarantine control (supervision) on customs area of the Eurasian Economic Union approved by the Decision of the Commission of the Customs union of June 18, 2010 No. 318, to add with the paragraph of the following content:

"In case of establishment by the official of authorized body of the state of the destination of that fact that the receiver of quarantine products specified in the phytosanitary certificate was not receiver of this batch of quarantine products (in case of receipt of the official address of the receiver of quarantine products about absence at it contractual relations with the sender of batch of quarantine products and (or) when obtaining from tax authority of the state of the destination of quarantine products of data on the status of the receiver of quarantine products (invalid, unregistered)), the authorized body of the state of the destination within 15 calendar days notifies on it authorized body of the state of the place of departure. In case of repeated identification (during 1 year from the date of establishment of the specified fact) the phytosanitary certificate which is drawn up with such violation and the first notification issued later, the authorized body of the state of the place of departure after receipt of the renewed notification from authorized body of the state of the destination sent to the same time refuses to the applicant specified in the phytosanitary certificate as the exporter issue of the following phytosanitary certificate to receivers of quarantine products of such state of the destination, except as specified changes of the status of the receiver of quarantine products after issue of the phytosanitary certificate. Such refusal is effective within 60 calendar days after receipt of the place of departure of the adequate notice by authorized body of the state from authorized body of the state of the destination.".

2. This Decision becomes effective after 30 calendar days from the date of its official publication.
