About modification of some regulations (strengthening of safety of judges and prosecutors)

Art. I. - Criminal code of the Republic of Moldova No. 985/2002 (repeated publication: 2009, Art. No. 72-74, 195), with subsequent changes to add the official monitor of the Republic of Moldova with Article 349-1 of the following content:

"Article 349-1. Threat or violence against the judge or prosecutor

(1) the Threat of murder, causing bodily harms or other harm to health, damage or destruction of property of the judge, prosecutor or their close relatives in case of execution by the judge or prosecutor of the powers provided by the law performed inclusive by means of information system if there were bases to be afraid of implementation of this threat,

it is punished by penalty in the amount of 850 to 1350 conventional units, or unpaid work for benefit of society for a period of 150 till 200 o'clock, or imprisonment for a period of up to 3 years.

(2) Use of violence, not life-threatening or health, concerning the judge, the prosecutor or their close relatives either damage or destruction of their property in case of execution by the judge or prosecutor of the powers provided by the law

are punished by penalty in the amount of 1000 to 1500 conventional units, or unpaid work for benefit of society for a period of 180 till 240 o'clock, or imprisonment for a period of 3 up to 5 years.

(3) the Actions provided by parts (1) or (2):

a) made by two or more persons;

b) using violence, life-threatening or health of persons specified in part (1);

c) with damage or destruction of property by means, life-threatening or health of great number of persons;

d) with causing damage in large sizes;

e) made using weapon or other objects used as weapon

are punished by imprisonment for a period of 5 up to 8 years.

(4) the Actions provided by parts (1), (2) or (3):

a) made by organized criminal group or the criminal organization or in their advantage;

b) entailed causing damage in especially large sizes,

are punished by imprisonment for a period of 7 up to 12 years.".
