About introduction of amendments to some laws of Ukraine of rather organizational bases of implementation of support in the agrarian sector

The Verkhovna Rada of Ukraine decides:

I. Make changes to such laws of Ukraine:

1. In the Law of Ukraine "About farm" (Sheets of the Verkhovna Rada of Ukraine, 2003, No. 45, Art. 363 with the following changes):

1) in Article 9:

in the name to replace the word of "help" with the word "supports";

in paragraph one of part one of the word "the help at the expense of means of the government budget, including through the Ukrainian state fund of support of farms " shall be replaced with words" support at the expense of means of the government budget through the Payment agency";

in paragraph one of part of the third word "About the state support of agricultural industry of Ukraine" shall be replaced with words" About bases of the state agrarian policy and state policy of rural development";

Article 10 to exclude 2);

Article 11 to state 3) in the following edition:

"Article 11. Support through the Payment agency

1. Support at the expense of means of the government budget through the Payment agency is provided to farms on irretrievable basis and on the competitive beginnings on returnable basis for implementation of productive activity and diversification of production according to the procedure, approved by the Cabinet of Ministers of Ukraine, and also is aimed at providing guarantees, guarantees when crediting of farms by banks";

In paragraph four of part three of Article 29 of the word of "Ukrainian of the state fund of support of farms" shall be replaced with words 4) "The payment agency".

2. In the Law of Ukraine "About the state support of agricultural industry of Ukraine" (Sheets of the Verkhovna Rada of Ukraine, 2004, No. 49, Art. 527 with the following changes):

1.3. Operation of this Law does not extend to the legal relationship regulated by the Land code of Ukraine and also to legal relationship on insurance of agricultural products with the state support according to the Law of Ukraine "About features of insurance of agricultural products with the state support" and receipts of the state support by subjects of small and medium entrepreneurship according to the Law of Ukraine "About development and the state support of small and medium entrepreneurship in Ukraine".

1.4. The relations concerning acceptance, entry into force, appeal administratively, accomplishment, cancellation of administrative acts are regulated by the Law of Ukraine "About ministerial procedure" taking into account the features determined by this Law";

3) in Article 2:

state Item 2.26 in the following edition:

"2.26. Producers of agricultural products - any physical persons or legal entities, and also associations of such persons having capacities in the territory of Ukraine on which they perform agricultural activities";

add with Items 2.32-2.42 of the following content:

"2.32. Zone of risk agriculture territory of conducting agricultural production with high risk level of loss (partial loss) of harvest of products of crop production or loss of other types of agricultural products owing to adverse climatic conditions or owing to conducting combat operations in such territory.

2.33. The payment agency - the budgetary institution belonging to the sphere of management of the central executive body, providing forming and realizing the state agrarian policy and state policy of rural development, performing administration of the support provided by this Law.

2.34. State policy of rural development system of the actions performed by the state for the purpose of ensuring sustainable development of the rural territories, improvement of quality of life and economic welfare of rural population, increase in competitiveness of producers of agricultural products, protection of the surrounding environment.

2.35. The state agrarian policy system of the actions performed by the state for the purpose of ensuring sustainable development of agricultural industry, food security, preserving natural resources, maintenance of competitiveness of domestic agricultural production.

2.36. The applicant on receipt of support in agricultural industry (further - the applicant) - physical person or legal entity which addresses for receipt of support.

2.37. The integrated system of administration and control - the state information (automated) system intended for ensuring implementation of monitoring, control and administration of support according to this Law.

2.38. Support in agricultural industry (further - support) - government assistance, support according to the law.

2.39. System of data on sustainable development of rural economy tool, intended for collection, accumulating, processing and data analysis of production, economic, financial, ecological and social nature concerning activities of producers of agricultural products.

2.40. The active producer of agricultural manufacturing products of agricultural products which gains more than 50 percent of the income from agricultural activities and mainly does not perform the activities included in the list of the types of activity which are not connected with agricultural industry (negative list).
