About introduction of amendments to the Criminal code of the Kyrgyz Republic

Article 1.

Bring in the Criminal code of the Kyrgyz Republic (the newspaper of "Erkin-limited liability partnership" of November 16, 2021 No. 122-133) the following changes:

in Article 137:

a) the paragraph one of part 1 to state in the following edition:

"1. Causing to any person of physical or mental sufferings with the purpose to receive from it or other person of the data or recognition, to punish him for act which was made by it or other person or in making of which it or other person is suspected, and equally to intimidate or force it or other person to making of certain acts, or because of discrimination of any nature, made by the official or person performing official powers or on its instigation, from its permission or as a result of its failure to act, -";

b) add with the note of the following content:

"Note. In this Article person performing official powers is understood as the person which is not falling under determinations of the official or public agent, but having powers to dispose, to exercise supervision, control, the training, treatment, content or other powers concerning persons which are from it in dependence performing the specified functions on permanent or temporary basis irrespective of the bases and procedure for its attraction to accomplishment of such functions, including according to the employment contract or the civil agreement.".

Article 2

This Law becomes effective after ten days from the date of official publication.
