Chapter 1. General provisions

Article 1. Subject of regulation of the law

1. This law establishes procedure and conditions of implementation of realtor activities in the Republic of Armenia, and also governs the relations connected with realtor activities.

Article 2. Law coverage

1. Operation of this law extends to the realtor activities performed in the territory of the Republic of Armenia.

2. This law does not extend on:

1) the transactions performed concerning the state-owned and municipal property;

2) the transactions made concerning the property recognized as public priority;

3) transactions of trust management of the real estate;

4) activities which correspond to the realtor activities established by this law, but are performed by state bodies and local government bodies within the functions assigned to them by the law;

5) activities which are regulated by the Law "About Bankruptcy";

6) the relations provided by the Law "About Investment Funds" and the legislation regulating activities of investment funds;

7) the relations provided by the Law "About Management of the Apartment House".

Article 3. The basic concepts used in the law

1. In this Law the following basic concepts are used:

1) realtor activities - the business activity directed to rendering the realtor services established by this Law;

2) realtor services - the intermediary services performed for alienation of the real estate and the existing property rights on it, the conclusion of the transactions connected with lease, and also the organization of auctions and tenders of the real estate and the existing property rights on it, real estate administration;

3) the realtor organization - the legal entity performing realtor activities and staying on the registry in authorized body in the procedure established by this law;

4) the realtor - the physical person having the existing qualification certificate of the realtor, staying on the registry in authorized body and in the procedure established by this law on behalf of the realtor organization and if it is individual entrepreneur, renders realtor services on its own behalf;

5) services in management of the real estate - provision of services, connected with profitable operation of the real estate, through managing company for the certain term specified in the agreement, transfer of the income from real estate administration to the owner, advertizing of real estate object within real estate administration, repair and maintenance of the real estate for the benefit of the owner, except for constructions;

6) the managing director of immovable property - the physical person which in the procedure established by this law is registered in authorized body and in the procedure established by this law on behalf of the organization for real estate administration and if it is individual entrepreneur, renders services in real estate administration on its own behalf;

7) the organization for management of immovable property - the legal entity performing services in real estate administration and staying on the registry in authorized body in the procedure established by this law;

8) the customer - the physical, legal entity or the individual entrepreneur who signed the contract with the realtor organization or the organization for real estate administration, or with the realtor who is the individual entrepreneur or with the managing director of the real estate who is the individual entrepreneur for rendering to them realtor services or services in real estate administration;

9) authorized body Committee of the inventory;

10) the agreement on rendering realtor services - the written agreement about rendering paid services signed between the customer and the realtor or the realtor organization who is the individual entrepreneur whose subject is provision of the realtor services established by this Law, connected with real estate;

11) the competence certificate of the realtor (further also - the competence certificate) - the electronic document issued by authorized body confirmatory that the physical person successfully passed the qualification examination of the realtor held by authorized body;

12) the qualification commission commission holding professional qualification examinations in the field of realtor activities in the territory of the Republic of Armenia, operating as a part of authorized body, including the questionnaire for qualification examinations, constituting questions for promotion;

13) the nomenclature of realtors (including being individual entrepreneurs) and managing directors of the real estate (including being individual entrepreneurs) - the database containing information on the realtor, surname, name, date, year, month, date and sequence number of the certificate of competency, year, month, date of suspension or cancellation of the certificate of competency and legal basis, the registration room in authorized body and also, on approval of the realtor and managing director of the real estate, contact information of the last, and in case of the realtors who are individual entrepreneurs and the managing directors of the real estate who are individual entrepreneurs, also this about the place of their activities and registration taxpayer number;

14) nomenclatures of the realtor organization and the organization for management of immovable property - the database containing information on the realtor organization, the name, the place of the organization activity performing activities for real estate administration, registration taxpayer number of the organization, registration number of authorized body and also, with the consent of the realtor organization and the organization for real estate administration, contact information of the last;

15) single information system - the paid information system operating online, implemented by authorized body which provides interaction with the websites of property sale and into which data on the real estate belonging to physical persons and legal entities, being alienation subject and also realtor services, services in real estate administration, and also information on their transactions and the client are entered;
