About modification of the Regulations on public procurements of works approved by the Order of the Government No. 638/2020

Based on Item h) article 6 of the Law No. 136/2017 on the Government (The official monitor of the Republic of Moldova, 2017, No. 252, the Art. 412), with subsequent changes, DECIDES: the Government

1. In the Regulations on public procurements of works approved by the Order of the Government No. 638/2020 (Official monitor of the Republic of Moldova, 2020, Art. No. 229-233, 785), to make the following changes:

1.1. in Item 2:

1.1.1. after the concept "public procurement of works" to add with the concept "estimate documentation" of the following content:

"estimate documentation - the part of the project documentation developed for cost determination of the financial resources necessary for accomplishment of construction works and realization of project tasks;";

1.1.2. state the concept "project documentation (engineering design)" of the following edition:

"the project documentation - set of the text and graphical materials accompanied with necessary calculations, developed according to technical regulations in construction, forming basis for accomplishment of construction works;";

1.1.3. state the concept "similar works" of the following edition:

"similar works - set of works which the offerer performed earlier, comparable on nature, technical complexity, the applied technology, functional purpose of the object, accomplishment conditions, amount of financial component and resulting effect with the subject of the agreement which is subject to the conclusion. Similar are considered to execute works which, everyone or in their set, confirm technical and professional capability of the economic operator the construction project of the same category and technical importance with observance of requirements for quality, terms and according to legislation provisions.";

1.2. add Item 27 with subitems 4) and 5) of the following content:
