About some questions of substitution of managerial state and municipal positions

For the purpose of further regulation of questions of substitution of managerial state and municipal positions, according to Articles 5, 17 Laws of the Kyrgyz Republic "About the public civil service and municipal service", article 71 of the Constitution of the Kyrgyz Republic I decide:

1. Bring in the Presidential decree of the Kyrgyz Republic "About approval of the Register of the state and municipal positions of the Kyrgyz Republic" of January 31, 2017 No. 17 the following changes:

Item 2 to state 1) in the following edition:

"2. Determine that:

- category of managerial state and managerial municipal position is the classification characteristic of set of the managerial positions held by the government civil servants and local government officers reflecting amount and nature of ex-officio full powers. The highest, main, senior, younger groups of managerial positions are subdivided into categories V-and, V-B, G-and, G-B, S-and, by S-B, M-and, M-B;

- the expenses connected with implementation of this Decree are performed within the means provided for state bodies and local government bodies;

- appointment in special (out-of-competition) procedure to separate managerial state and municipal positions is performed on condition of compliance of the designated person to the qualification and other requirements established by the legislation in the field of the public civil service and municipal service;

- substitution of vacant managerial state positions in central offices of the ministries in special (out-of-competition) procedure in the quantity which is not exceeding ten percent from the established number of staff of central office of the ministry is performed for the purpose of ensuring development and effective realization of reforms in the corresponding field of activity of the ministry.";
