The economic council of the Commonwealth of Independent States solved:

1. Take into consideration the Overview of trade policy of the Republic of Kazakhstan (is attached).

2. Send the provided Overview to the governments of gosudarstvuchastnik of the CIS for informing the interested ministries and departments.

3. Charge to Executive committee of the CIS to publish in a month the specified Overview and post it on the website of Executive committee of the CIS on the Internet.

Overview of trade policy of the Republic of Kazakhstan

The overview of trade policy of the Republic of Kazakhstan is constituted according to the Procedure for carrying out reviews of trade policy of the State Parties of the CIS approved by the Decision of Economic council of the Commonwealth of Independent States of March 15, 2002.

The overview is prepared by Executive committee of the CIS on the basis of the national report provided by the Ministry of the industry and trade of the Republic of Kazakhstan, and information on the matter which is available for Executive committee of the CIS.

The purpose of reviews of trade policy is achievement by the State Parties of the CIS of transparency of trade policy, assistance to observance of the rules, regulations and obligations fixed in international treaties and documents concerning forming and effective functioning of the free trade area and also regular carrying out objective assessment of the main indicators of trade policy and practice of the states of the Commonwealth, their influence on development of mutual trade.

1. Mode of trade policy

The main task facing the Republic of Kazakhstan is the entry of Kazakhstan into the World Trade Organization. The fastest transition to the international standards and rules will determine in many respects national economy competitiveness. It is the process requiring certain implementation phases one of which includes establishment of mandatory and voluntary requirements to products and harmonization of the Kazakhstan model of technical regulation with the international practice. Five new bills are drafted:

- "About safety of toys";

- "About safety of chemical products";

- "About safety of machines and the equipment";

- "About electromagnetic compatibility";

- "About safety of food products".

Main objective of bills - reduction of the legislation of the Republic of Kazakhstan in compliance with requirements of the Law of the Republic of Kazakhstan "About technical regulation" and the international practice of legal regulation of the relations connected using, execution and establishment of minimum necessary mandatory requirements to products.

Now in Kazakhstan there is no regulatory legal act establishing single requirements for safety. These bills determine minimum necessary requirements to mechanical, chemical, fire, biological and to other types of safety to which there shall correspond products placed in the market of the Republic of Kazakhstan.

For implementation of the drafted bills the Plan for development of technical regulations for 2007 - 2009 is created.

2. Measures of trade policy and practice of its application

2.1. Import regulation

Customs clearance of goods and vehicles. List of the documents necessary in case of submission of the cargo customs declaration

Submission of the cargo customs declaration (CCD) shall be followed by representation of necessary documents to customs authority based on which the cargo customs declaration and confirmatory is filled in:

1) powers of the customs applicant on giving of GTD from own name, the power of attorney to the physical person which is in staff of the customs applicant or the contract for rendering broker services and the competence certificate of the specialist in customs clearance;

2) the property right, orders or uses to the goods which are subject to customs clearance, - the agreement in foreign trade (contract) of purchase and sale or exchange, the agreement or other document on the right of the order or use to the goods which are subject to customs clearance;

3) movement of goods through customs border of the Republic of Kazakhstan, - transport documents;

4) customs value of goods, - the invoice (invoice), the pro forma bill, the specification and other documents provided for the statement and determination of customs value of goods according to Chapter 39 of the Customs code;

5) goods origin, - the declaration on goods origin or the certificate of origin;

6) payment or providing customs payment and taxes depending on conditions of customs regime and availability of privileges on customs payment and taxes:

- the payment order with mark of bank about payment execution via bank transfer or the receipt to the cash receipt order of customs authority, bank - in case of cash payment by money;

- the documents confirming providing customs payment and taxes;

- the documents confirming provision of privileges on customs payment and taxes;

- the documents confirming provision of delay (payment by installments) on payment of customs duties, the value added tax;

7) the goods delivery to the destination, - the document of control of the goods delivery (DKD) or other documents according to the international treaties ratified by the Republic of Kazakhstan;

8) observance of requirements in the field of currency exchange control, the documents required according to the foreign exchange legislation of the Republic of Kazakhstan (transaction certificate);

9) compliance to mandatory requirements of standards in case of commodity importation irrespective of the declared customs regimes, phytosanitary, veterinary (quarantine) certificates. The specified certificates are represented only in the cases established by regulatory legal acts of the Republic of Kazakhstan for goods on which submission of certificates is obligatory:

- the certificate of conformity on safety of products on goods for which submission of the certificate is obligatory according to the legislation of the Republic of Kazakhstan, or the statement declaration in the form established by the relevant authorized state body (authorized body - Committee of metrology, standardization and certification of the Ministry of the industry and trade of the Republic of Kazakhstan);
