About modification and amendments in the orders of the Government of the Republic of Kazakhstan of May 12, 2011 No. 506 "About approval of Rules of use of airspace of the Republic of Kazakhstan and modification of the order of the Government of the Republic of Kazakhstan of December 31, 2010 No. 1525 and about recognition voided some decisions of the Government of the Republic of Kazakhstan" and of November 4, 2011 No. 1296 "About approval of Rules on the organization of search and rescue ensuring flights in the territory of the Republic of Kazakhstan"

The government of the Republic of Kazakhstan DECIDES:

1. Bring the following changes and amendments in some decisions of the Government of the Republic of Kazakhstan:

1) in the order of the Government of the Republic of Kazakhstan of May 12, 2011 No. 506 "About approval of Rules of use of airspace of the Republic of Kazakhstan and modification of the order of the Government of the Republic of Kazakhstan of December 31, 2010 No. 1525 and about recognition voided some decisions of the Government of the Republic of Kazakhstan":

in the Rules of use of airspace of the Republic of Kazakhstan approved by the specified resolution:

in Item 2:

2) to state the subitem in the following edition:

"2) the current plan of flight (CPL) – flight plan which reflects the possible changes in the provided flight plan caused by the subsequent dispatching permissions of body of servicing of air traffic;";

12) to state the subitem in the following edition:

"12) route of servicing of air traffic (further – Department of Internal Affairs) – the established route which is intended for the direction of flow of movement for the purpose of ensuring servicing of air traffic. The term "route of Department of Internal Affairs" is used for designation in appropriate cases of the airway, supervised or uncontrollable route, route of arrival or departure and other routes.

The route of Department of Internal Affairs is determined by route technical requirements which include index of route of Department of Internal Affairs, the line of way to the main points (points of way) or in the opposite direction, distance between the main points, requirements for transfer of reports and the lowermost safe absolute height;";

state Item 7-2 in the following edition:

"7-2. Need for separation of the region of flight information into the upper and lower areas is determined by the supplier of aeronautical servicing subordinated to authorized body in the field of civil aviation.";

state Item 17-1 in the following edition:

"17-1. For each object (polygon, shooting range, training center, pit, the field, the mine, section) on which the works connected with production of firing practice, missiles launches, explosive works, uncontrollable aerostats are carried out (except for uncontrollable aerostats which are classified as lungs according to Item 83-1 of these rules), and other activities posing safety hazard of flights, the owner or the body responsible for operation of object are performed, the agreement on interaction with the Department of Internal Affairs centers in which coordination measures between the Department of Internal Affairs center and body of Department of Internal Affairs for time of the beginning and cessation of work, establishment of vertical and horizontal borders and measure for interaction are specified is drafted. The agreement on interaction is approved with the Department of Internal Affairs center and body of Department of Internal Affairs around which responsibility there is object, and affirms the responsible person (head) of object.

In case of approval of the agreement on interaction the body of Department of Internal Affairs can initiate change of vertical and horizontal borders, and also the action period for the purpose of safety in case of production of flights.";

add Item 82-1 with subitems 7) and 8) of the following content:

"The route (the planned trajectory) passes 7) in limits or through the prohibited area, zone of restriction of flights, zone of restriction of flights of pilotless aircrafts and the operator special permission of authorized body in the field of the state aircraft is got;

8) when flying using the BASS of experimental aircraft.";

state Item 100 in the following edition:

"100. The HZ of PVD brings the flight plan received from the Kazakhstan operator of the aircraft in the plan of use of airspace:

1) in the presence of the existing air operator certificate and operational specifications attached to it (for airlines);

2) in the presence of the existing certificate on the right of accomplishment of aviation works and the operational specifications attached to it (for the operators planning accomplishment of aviation works);

3) in the presence of the existing certificate on the right of accomplishment of flights and the operational specifications attached to it (for the operators of aircraft of general purpose operating airplanes with the maximum certified take-off weight over 5700 kilograms), and also the existing certificate of the flight validity (for the operators of aircraft of general purpose operating airplanes with the maximum certified take-off weight less than 5700 kilograms and helicopters irrespective of the maximum certified take-off weight);

4) in the presence of the existing certificate of the flight validity and the certificate on state registration of the civil aircraft (for all operators of aircrafts), and for the aircrafts which do not have the existing certificate of the flight validity – permissions of authorized organization in the field of civil aviation on accomplishment of special flight;

5) in case of compliance of the provided flight plan established by these rules to form and content (for all operators of aircrafts);

6) in the presence of the reference of the repair or assembly shop signed by the first director about readiness of the aircraft for accomplishment of test flight or flight;

7) for the aircrafts involved (declared) in watch on search and rescue providing flights according to the signed contracts with the supplier of aeronautical servicing in case of accomplishment of flights with indication of in flight plan of the name of the purposes and liter of the flights answering the purpose with the symbol HUM, HOSP, MEDEVAC, SAR, FFR, 04, of 02, letters "OK" and "personal computer" according to appendix 4 to these rules and on condition of cover of the region of responsibility by guard search and rescue aircrafts of adjacent areas of search and rescue.

The authorized organization in the field of civil aviation without delay represents to HZ of PVD of the copy of the issued air operator certificates, certificates on accomplishment of aviation works, certificates on the right of accomplishment of flights, certificates of the flight validity and the certificate on state registration of civil aircrafts.";

add Item 177-4 with the subitem 6) of the following content:

"6) informs the bodies of Department of Internal Affairs servicing the neighboring regions of flight information (FIR) if as a result of course deviation the aircraft went beyond or entered limits of the neighboring regions of flight information (FIR).";

add with Item 177-9 of the following content:

"177-9. As soon as the body of Department of Internal Affairs learns that outside its region of responsibility (in the delegated airspace) interception of the aircraft is performed, it takes those from the measures stated below which are suitable in these conditions:
