About introduction of amendments to the Law on National Bank of Moldova No. 548/1995 (aspects of institutional management)

The Parliament adopts this organic law.

Art. I. - In the Law on National Bank of Moldova No. 548/1995 (repeated publication: The official monitor of the Republic of Moldova, 2015, Art. No. 297-300, 544), with subsequent changes to make the following changes:

1. In article 2 to state the concept "Gross misconduct" of the following edition:

"Gross misconduct - the illegal action or failure to act made in case of execution of professional obligations which is rather serious to justify release of the responsible person from position, and also in case of the member of the Supervising council specified in Item d) parts (1) Articles 23, - absence without reasonable excuse at three meetings of Supervising council in a row.".

2. In Article 23:

in part (1):

c) to declare Item invalid;

in Item d) to replace the word of "four" with the word of "five";

part (to add 3) with the text of the following content: "Before representation to Parliament of the offered candidate the Chairman of the parliament requests the advisory proceeding of Supervising council concerning the candidate's compliance to the conditions provided by part (7). The advisory proceeding of Supervising council is submitted to Parliament before removal at vote of question of position assignment of the offered candidate. The conclusion specified in this Item and Items (4) and (5), it is issued according to the internal regulations approved by Supervising council.";

part (to add 4) with the text of the following content: "Before representation to Parliament of the offered candidate the president of National Bank consults with Supervising council concerning the candidate's compliance to the conditions provided by part (7). The advisory proceeding of Supervising council is submitted to Parliament before removal at vote of question of position assignment of the offered candidate.";
