About agent activities on the real estate

The Parliament adopts this organic law.

Chapter I. General provisions

Article 1. Sphere of regulation

(1) This law regulates the intermediary activities in the field of the real estate performed by real estate agents and real estate agencies and establishes the legal base, professional requirements, the rights and obligations of those, and also measures for supervision and applicable punishments for the purpose of providing transparent, competitive and fair environment in the real estate market.

(2) Operation of this law extends on the physical persons and legal entity performing intermediary activities in the field of the real estate.

Article 2. Law purpose

The purpose of this law is providing the legal base for implementation of intermediary activities in the field of the real estate founded on the principles of transparency, conscientiousness and professionalism, way:

a) protection of legitimate rights and interests of clients and participants of real estate transactions;

b) establishments and applications of professional standards for real estate agents for the purpose of improvement of quality of services and their predictability;

c) prevention inadequate, illegal and unfair trade practice and fight against it by regulation according to the principles of consumer protection and competition;

d) providing correctness, transparency and possibility of check of real estate transactions for the purpose of observance of the tax legislation, and also by the prevention of tax avoidance, money laundering and other risks characteristic of the real estate market.

Article 3. Concepts

For the purposes of this law the following concepts are used:

1) the real estate agent – the physical person certified according to this law performing intermediary activities in the field of the real estate;

2) real estate agency – the legal entity or the individual entrepreneur who is registered/registered according to the law which/which performs intermediary activities in the field of the real estate through the certified real estate agents;

3) central administrative authority – The agency of geodesy, cartography and inventory given this law authority on regulation, certification and monitoring of intermediary activities in the field of the real estate;

4) the certificate of the real estate agent – the allowing document issued by the central administrative authority through the Automated management information system and issues of allowing documents (SIA GEAP), confirming the right to implementation of intermediary activities in the field of the real estate;

5) the certificate on professional competence – the education document which is issued by the organization having permission to temporary activities or accredited according to the legislation in the field of education and which confirms passing by the real estate agent of basic/continuous professional training;

6) the client – physical person or legal entity to which intermediary services in the field of the real estate based on the intermediary agreement in the field of the real estate are rendered;

7) conflict of interest – situation in which private, financial or professional interests of the real estate agent influence or can influence impartial and objective accomplishment by this agent of the obligations assigned to it by the law and responsibility;

8) mediation in the field of the real estate – the activities performed on paid basis by real estate agents or real estate agencies which consist in the following:

a) mediation and assistance in transactions which subject is real estate;

b) provision of the accompanying services, including promotion, consultation and assistance in the course of real estate transactions;

c) action from name or for the benefit of the client on the basis of the intermediary agreement signed in writing in the field of the real estate;

9) the Real estate agents module – the information subsystem intended for accounting of real estate agents and real estate agencies, and also for management of activities for their certification and monitoring;

10) remuneration – the cost of intermediary services in the field of the real estate established in percentage ratio or in fixed amount according to the intermediary agreement in the field of the real estate.

Article 4. The basic principles of intermediary activities in the field of the real estate

Intermediary activities in the field of the real estate are based on the following principles:

a) legality – implementation of activities with compliance with law;
