About modification of some legal acts of the Kyrgyz Republic (in the Code of the Kyrgyz Republic about offenses, the Law of the Kyrgyz Republic "About external migration")

Article 1.

Bring in the Code of the Kyrgyz Republic about offenses (the newspaper of "Erkin-limited liability partnership" of November 16, 2021 No. 122-133) the following changes:

Part 2 of Article 32 to state 1) in the following edition:

"2. Foreign citizens are subject to expulsion out of limits of the Kyrgyz Republic for making of the offenses connected with violation of procedure for their stay in the Kyrgyz Republic, and also provided by Articles 126-1 and 126-2 of this Code, except as specified stipulated by the legislation.";

To add 2) with Articles 126-1 and 126-2 of the following content:

"Article 126-1. Begging

1. Occupation begging on the carriageway of roads, and also sticking or the importunate address in public places for the purpose of receipt of money or other material values -

attract attraction to social jobs for a period of 20 till 30 o'clock or application of arrest up to three days.

2. The same actions provided by part of 1 this Article committed repeatedly within one month after application of disciplinary measures, -

attract attraction to social jobs for a period of 30 till 40 o'clock or application of arrest from three to five days.

3. The same actions provided by part of 1 this Article, made by the foreign citizen repeatedly within one month after application of disciplinary measures -

attract expulsion of the foreign citizen out of limits of the Kyrgyz Republic.

Note. Person is exempted from liability for the actions provided by this Article if it is determined that it made these actions owing to application to it physical or psychological abuse, threat or other form of coercion, and also in case of recognition by its victim of human trafficking.
