About change of the laws concerning rule-making activities

Article 1. Bring in the Law of the Republic of Belarus of July 17, 2018 No. 130-Z "About regulatory legal acts" the following changes:

1. In Item 2 of Article 1 "(individual)" shall be replaced with words the word "(including individual)".

2. In Article 2:

Item 6 after the word to "acceptance" to add with words "to signing, inclusion in the National register of legal acts of the Republic of Belarus (further - the National register of legal acts),";

Item 9 after the word" (edition)," to add with words "to inclusion in the National register of legal acts,".

3. In Article 3:

the eleventh to state the paragraph to part one of Item 2 in the following edition:

"the technical regulatory legal acts which are according to legal acts and resolutions of Council of Ministers of the Republic of Belarus obligatory for observance.";

add Article with Item 5 of the following content:

"5. The regulatory legal acts containing exclusively digital indicators (indexes, coefficients, standard rates, limits and other indicators) accepted by the ministries, other republican state bodies subordinated to Council of Ministers of the Republic of Belarus regional and Minsk city Councils of deputies, regional and Minsk city executive committees, local councils of deputies, executive and administrative organs of basic territorial level (further - the regulatory legal acts containing exclusively digital indicators), are subject to separate accounting as a part of the legislation. Such acts are placed in the databank "Unified Register of Digital Indicators" created by the National center of the legislation and legal information without conducting their obligatory legal examination and inclusion in the National register of legal acts.

The list of the digital indicators established by the regulatory legal acts specified in part one of this Item, and procedure for maintaining the databank "Unified Register of Digital Indicators" are determined by Council of Ministers of the Republic of Belarus.".

4. To add Item 2 of article 4 after the paragraph of the fifth with the paragraph of the following content:

"projects of zones of protection of immovable material historical and cultural values, projects of the water protection zones and coastal strips, schemes of land management, town-planning projects of detailed planning. Obligation of application of such acts is provided by regulatory legal acts based on which they are accepted (are published);".

5. In Article 6:

6. To add part one of Item 3 of Article 11 with the offer of the following content: "The term determined calendar date with use of pretext "to" expires in day of approach of the corresponding calendar date.".

7. In Article 25:

add item 4 with part of the following content:

"Technical regulatory legal acts, as a rule, do not join the provisions having theoretical, descriptive and information character.";

state Item 5 in the following edition:

"5. Technical regulatory legal acts (their projects) are subject obligatory legal and (or) to other examinations according to articles 47 and 481 of this Law and other legal acts.

The technical regulatory legal acts (except for the technical regulatory legal acts approved by legal entities and individual entrepreneurs) which are according to legal acts and resolutions of Council of Ministers of the Republic of Belarus obligatory for observance are subject to inclusion in the National register of legal acts, official publication on the National legal Internet portal of the Republic of Belarus, and also to placement on other information resources on the global computer Internet (if other is not established by the international obligations of the Republic of Belarus).".

8. In part one of Item 2 of Article 26:

from word paragraph two of "the washing-away and neutralizing means", and "statistical value indexes and indexes of change in value of installation and construction works," to exclude;

the third and fourth to state paragraphs in the following edition:

"structures and formats of electronic documents, job evaluation catalogs, professional standards, Single sports classification, statistical qualifiers, standards of carrying out calculations, standards of financial services and technologies;

forms of the state statistical observations and instruction for their filling, methods of forming and calculation of statistics, instructions on the organization and carrying out the state statistical observations, forms of the departmental reporting and instruction for their filling (in case of their distribution on unmastered (not being part, system) the organizations);";

from the paragraph of the fifth word "requirements for registration of qualification scientific works (theses) and abstracts," to exclude.

9. In Article 28:

state Item 1 in the following edition:

"1. The main requirements of the rule-making equipment are:

logical creation of the project of regulatory legal act (further if other is not determined, for the purposes of this Chapter - regulatory legal act), lack of internal contradictions;

brevity, clarity and accuracy of formulation of normative legal instructions, simplicity and availability of their statement;

completeness of legal regulation by regulatory legal act of the corresponding public relations;

unity of terminology in the legislation, uniformity and unambiguity of terminology of regulatory legal act;

preparation of regulatory legal act according to the requirements provided by appendix to this Law and also with requirements of the legislation in the field of archiving and clerical work if they do not contradict this Law.

By preparation of the draft of the legal act for the purpose of simplification of perception of its text reasonable departure from the requirements provided by appendix to this Law is allowed.";

to add part one of Item 2 with words ", lack of internal contradictions";

in Item 3:

state part one in the following edition:

"3. Brevity, clarity and accuracy of formulation of normative legal instructions, simplicity and availability of their statement mean that contents of these instructions shall be specific, unambiguous and sufficient, excluding their ambiguous understanding and not uniform application.";

after part one to add Item with part of the following content:

"In case of statement of normative legal instructions the rule-making body (official) shall take the measures directed to reducing amount of regulatory legal act, exception of the excessive provisions which do not have independent semantic value.";

after part five to add Item with part of the following content:

"The regulatory legal act containing exclusively digital indicators does not join other normative legal instructions, except for the final provisions connected with establishment of such digital indicators.".

10. To add Item 2 of Article 29 with the paragraph of the following content:

"take other measures directed to simplification of perception of the text of regulatory legal act.".

11. In Article 33:
