About additional measures for cardinal enhancement of system of rendering social services to persons with disability having mental disturbances

For the purpose of implementation of the new social services aimed at providing full participation in life of society of persons with disability having mental disturbances, supports of persons occupied with care of them and also adjustments of new system of work with the children having inborn defects in physical and intellectual development I decide:

I. Purposes

1. Determine main objectives of adoption of this Decree:

(a) rendering social services to the families performing care of children with the revealed defects in physical and intellectual development by means of early intervention;

(b) implementation of the complex social services directed to the smallest restriction of freedom of persons with disability having mental disturbances, and their integration into society in the conditions which are brought closer to the family circle;

(c) broad attraction of the non-state sector to processes of rendering social services to persons with disability having mental disturbances.

II. Implementation of new social services

2. For the purpose of early detection of the defects which are observed in physical and intellectual development of children, their timely scope by complex social services prevention of disability and ensuring successful socialization of children with disability to implement step by step till June 1, 2026 the service "Erta Aralashuv" ("Early intervention").

3. Establish procedure according to which:

(a) within the service "Early Intervention":

(i) services by the non-state organizations included in the special electronic register which maintaining is performed by the National agency of social protection in case of the President of the Republic of Uzbekistan (further - the Agency) in the information system "Single National Social Protection" are rendered to children up to three years to which disability or having defects in physical and intellectual development is established according to the plan of early intervention;

(ii) to children there is correctional developing pedagogical help by special teachers, and also medical physical culture instructors give the rehabilitation classes aimed at the complex development;

(b) the expenses connected with carrying out additional physical examination and surgeries of the children with anatomic defects having strong indications of disability become covered in the procedure established by the legislation by fund of national health insurance.

4. Take into consideration that:

(a) according to the Convention of the United Nations (further - the UN) about the rights of disabled people rendering services to persons with disability in residential form is the discriminating practice;

(b) according to the Guidelines on deinstitutionalization of UN committee on the rights of disabled people the refusal of all forms of rendering services in residential form, recognition of the fact that rendering services in this form contradicts the rights of persons with disability on independent accommodation and integration into social life of society is established.

5. Approve the offer of the Agency on step-by-step implementation of rendering to persons with disability of I and II groups with the diagnosis "intellectual backwardness" of moderate, heavy and deep degree or "dementia", the following new social services in the form which is brought closer to the family circle:

(a) till June 1, 2026 services of supervision in the form of day visit of "Yangi of kuna" ("New day");

(b) till September 1, 2026 services of supervision in house conditions. At the same time the service of supervision in house conditions, according to the procedure of exception, also appears to the children needing long leaving, having diseases which list affirms the Cabinet of Ministers;

(c) till October 1, 2026 services of the low-complete house Madad ("Help");

(d) till November 1, 2026 "Izhtimoy tajtit services of short-term placement" ("Social leave"). At the same time this service:

(i) Madad will be organized in low-complete houses;

(ii) there are based on the agreement signed with the legal representative of persons with disability of I and II groups having mental disturbances, included in the Social register, once a year for the term defined by the agreement, but no more than two weeks.

6. Determine that regions in which the new social services provided by Items 2 and 5 of this Decree will take root step by step are determined by the Agency.
