About modification of some regulations (specifying of country of source of foodstuff)
The Parliament adopts this organic law.
Art. I. - Law on domestic trade No. 231/2010 (repeated publication: 2021, Art. No. 230-237, 262), with subsequent changes to add the official monitor of the Republic of Moldova with Article 19-1 of the following content:
"Article 19-1. Instruction of country of source of foodstuff
(1) In case of retail trade by previously packed foodstuff if specifying of country of source is obligatory according to article 24 of the Law on informing consumers concerning foodstuff No. 279/2017 or if this information is specified the businessman voluntarily, the relevant information is displayed on the price label and shall correspond in accuracy to information on the label.
(2) In case of retail trade by previously unpacked foodstuff, and also the foodstuff packed in the place of sale at the request of the consumer or previously packed for sale directly the businessman specifies on the price label of product information on country of source based on the data supported by the trade documents and documents on traceability relating to the batch offered for sale.
(3) the Country of source is specified by means of the name of the country. The flag can be used as the accompanying graphical element of country of source. Graphical representation of flag without specifying of country of source is forbidden.
(4) the Mark about country of source shall be printed on the price label or on the announcement located in close proximity to goods, with use of font the size 0,3 suffices see.
(5) Provisions of this Article are applied to retailers with floor spaces of B, C and D according to appendix 5.".
Art. II. - In the Code of the Republic of Moldova about offenses No. 218/2008 (repeated publication: The official monitor of the Republic of Moldova, 2017, Art. No. 78-84, 100), with subsequent changes to make the following changes:
