About introduction of amendments to the Law on condominium No. 187/2022

The Parliament adopts this organic law.

Art. I. - In the Law on condominium No. 187/2022 (Official monitor of the Republic of Moldova, 2022, Art. No. 238-244, 467), with subsequent changes, to make the following changes:

1. Part (Article 22 to state 3) in the following edition:

"(3) the Decision on creation of association is deemed accepted and is valid if it:

a) signed more than one quarter of number of owners in condominium - in case of the associations including one condominium;

b) signed more than half of number of owners in condominium - in case of the associations including several condominiums according to provisions of part 8 of this Chapter.".

2. Add Article 32 with part (4-1) following of content:

"(4-1) Two or more persons who are owners, joint owners or representatives of joint owners of the same unit in condominium cannot be appointed at the same time members of bodies of association.".

3. In Article 37:

add Article with parts (1-1) and (1-2) following contents:

"(1-1) According to the procedure of departure from part provisions (1), in case of elections of the administrator of association, members of council, the chairman of the board, the auditor or members of audit committee, elections within the general meeting held by means of correspondence or in the mixed form are considered valid if the owners having more than half of voices of owners in condominium participated in vote.

(In case of elections of collegiate organ, chosen the candidates who received the greatest number of voices in decreasing order of quantity of the valid voices and within the number of places to which they are elected are considered 1-2)."

Item (c) of part (to declare 2) invalid;

add Article with parts (3) and (4) the following content:

"(3) the Decision on approval of the annual budget of association (the planned income, the planned expenses and the direction of the corresponding expenses) is accepted by voices more than half from total number of owners in condominium.
