About reorganization of the Agency of the environment

Based on Items b) and e) article 7 of the Law No. 136/2017 on the Government (The official monitor of the Republic of Moldova, 2017, No. 252, the Art. 412), with subsequent changes, parts (7) Article 14 and part (1) article 15 of the Law No. 98/2012 on the central branch public management (The official monitor of the Republic of Moldova, 2012,№160-164, 537), with subsequent changes, the Government DECIDES: the Art.

1. Reorganize the Agency of the environment as the accepting legal entity by merging (accession) with the Agency on geology and mineral resources as the attached legal entity.

2. Transfer 41 units of personnel (specialized personnel) to the Public organization "Body of Meteorology and Monitoring of the Environment" created in the course of reorganization of the Public hydrometeorological service.

3. Increase by 40 limiting units the number of staff of the Agency of the environment for the purpose of ensuring realization approved the politician in the field of management of chemicals and waste, environmental protection and climate change, regulations of genetically modified organisms and protection of habitats.

4. Transfer from the Agency on geology and mineral resources with the extreme number of staff of 20 units to the Agency of the environment of 16 established posts and to the Ministry of the environment - 4 established posts. Release of personnel in connection with reorganization of the Agency of the environment and the Agency on geology and mineral resources in case of impossibility of its transfer to perform according to the labor law. To cover the expenses connected with release of personnel for the account and within financial resources of the Agency of the environment and, respectively, the Agency on geology and mineral resources, depending on organization in which the released person worked before reorganization.

5. To the ministry of the environment:

5.1. take all necessary actions for implementation of process of reorganization according to provisions of this resolution;

5.2. found the commission on cession of property of the attached legal entity to the accepting legal entity and within 90 days from the effective date of this resolution to provide cession of property, being in management of the reorganized legal entities. Perform cession of property according to the Regulations on procedure for transfer of objects of public property approved by the Order of the Government No. 901/2015;

5.3. within 9 months from the effective date of this resolution to develop and submit for approval to the Government of the offer on modification of the regulations connected with reorganization process.

6. Declare invalid the Order of the Government No. 485/2009 about approval of the Regulations on the Agency on geology and mineral resources (The official monitor of the Republic of Moldova, 2009, Art. No. 124-126, 536), with subsequent changes.

7. In Item 2 of the Order of the Government No. 145/2021 on the organization and functioning of the Ministry of the environment (Official monitor of the Republic of Moldova, 2021, Art. No. 206-208, 343), with subsequent changes, to replace figures "96" with figures "100".

8. In the Order of the Government No. 549/2018 about creation, the organization and functioning of the Agency of the environment (Official monitor of the Republic of Moldova, 2018, Art. No. 210-223, 603), with subsequent changes, to make the following changes:

8.1. in the resolution:

8.1.1. 3) of Item 2 to declare the subitem invalid;

8.1.2. in Item 3 of figure "145" to replace with figures "160";

8.2. state appendices No. 1 and 2 in the following edition:

Regulations on the organization and functioning of the Agency of the environment

I. General provisions

1. The regulations on the organization and functioning of the Agency of the environment (further - the Provision) regulate its mission, spheres of activity, functions, powers, the rights and procedure for its organization.

2. The agency of the environment (further - the Agency) is the administrative authority subordinated to the Ministry of the environment (further - the Ministry), responsible for realization of state policy in the spheres of activity entrusted to it.

3. The agency is legal entity of the public law, has own name, seal with the image of the State Emblem of the Republic of Moldova, treasurer accounts, financial and appliances, and also other characteristic attributes of bodies of the public power established by the legislation.

4. The location of the Agency is established in municipium of Chisinau. As a part of the Agency the territorial deconcentrated subdivisions without the status of the legal entity managed by directly central office of the Agency with implementation of financial expenses on their content function.

5. Financing and material logistics of activities of the Agency are performed at the expense of means of the government budget and from other sources, stipulated by the legislation.

6. The agency cooperates in areas of the activities with bodies of the public power, bodies of local public authority, public organizations, bodies, the equipped control functions, with non-profit organizations, and also with profile foreign organizations in the areas provided in Item 9.

7. The agency is guided in the activities by the Constitution of the Republic of Moldova, the Law No. 98/2012 on the central branch public management, the Law No. 136/2017 on the Government and other regulations.
