About introduction of amendments to the Law of the Azerbaijan Republic "About patents"

Millie Majlis of the Azerbaijan Republic, being guided by Item 13 of part I of article 94 of the Constitution of the Azerbaijan Republic, decides:

In the Law of the Azerbaijan Republic "About patents" (The collection of legal acts of the Azerbaijan Republic, 1997, No. 5, Article 414 (volume I); 2024, No. 6 (the book I), Article 631) to make the following changes:

1. By the first part of Article 1:

1.1. in the fifth paragraph the word "organization" shall be replaced with words "body (organization)";

1.2. state the ninth paragraph in the following edition:

"the patent application - set of the documents constituted for the purpose of receipt of the patent for the invention, useful model and industrial design, reflecting result of creative activities of the author (authors) in objective form (on paper or in electronic format) and provided to the body (organization) determined by the relevant executive body";

1.3. Add the tenth the twelfth paragraphs of the following content:

"The Eurasian request - the request for issue of the Eurasian patent for the invention or industrial design according to the Eurasian patent convention of September 9, 1994 (further the referred to as Eurasian patent convention) and the Protocol to the Eurasian patent convention on protection of industrial designs;

The international request - the application submitted according to the Agreement on patent cooperation of June 19, 1970;

2. In Article 2.1 of the word "this Law and other legal acts adopted according to this Law and international treaties which participant is the Azerbaijan Republic" shall be replaced with words "this Law and other regulatory legal acts regulating questions of intellectual property on the basis of international treaties which participant is the Azerbaijan Republic".

3. In Article 3:

3.1. to replace the word "invention" in heading with the word "Invention";

The existing amount of knowledge also includes requisitioning instruments on the invention, useful model and industrial design which is earlier provided to the body (organization) determined by the relevant executive body, with priority date and not withdrawn, and also the invention, useful model and industrial design protected by the patent in the Azerbaijan Republic".

7.2. In the first offer of Part 4 of the word "in organization" shall be replaced with words "in body (organization)".
