About ensuring salary payment and remunerations
For the purpose of the ensuring timely salary payment and (or) other payments made according to the legislation on work (further - the salary), remunerations under civil agreements (further - remuneration):
1.1. in case of identification by Department of State Labour Inspection of the Ministry of Labour and Social Protection, its territorial subdivisions (further - Department) the nonpayment facts (incomplete payment) at the scheduled time:
the salary to workers the Department takes out obligatory for execution legal * or physical person the requirement about elimination of violations of the law about work for ensuring salary payment;
remunerations to citizens of the Republic of Belarus, foreign citizens and stateless persons (further - citizens) the Department takes out the requirement, obligatory for execution by legal entity or physical person, about elimination of violations of the civil legislation for ensuring payment of remuneration.
The procedure for removal by Department of the requirements specified in paragraphs second and third to part one of this subitem (further - requirements of Department), is established by Council of Ministers of the Republic of Belarus if other procedure is not determined by legal acts.
Identification of the nonpayment facts by Department (incomplete payment) by legal entity or physical person of the salary and (or) remuneration can be performed by receipt of information and studying of the documents connected with charge and salary payment and (or) remunerations;
