About modification of the Regulations on the BankID System of the National Bank of Ukraine

According to Articles 7, of 15, 56 Laws of Ukraine "About the National Bank of Ukraine", Articles 11-11-2, 14, 36 Laws of Ukraine "About electronic identification and electronic confidential services", for the purpose of reduction of the regulatory legal act of the National Bank of Ukraine in compliance with requirements of the legislation of Ukraine in the field of electronic identification and ensuring effective functioning of the BankID System of the National Bank of Ukraine the Board of the National Bank of Ukraine decides:

1. Make changes to Regulations on the BankID System of the National Bank of Ukraine approved by the resolution of Board of the National Bank of Ukraine of March 17, 2020 No. 32 (in edition of the resolution of Board of the National Bank of Ukraine of September 01, 2023 No. 105) (with changes) (further - the Provision), having been reworded as follows it which is applied.

2. Identifying subscribers shall bring till June 30, 2026 the activities into accord with requirements of the Provision and inform on it the National Bank of Ukraine till August 01, 2026.

3. To department of payment systems and innovative development (Andrey Podderegin) to inform subscribers of the BankID System of the National Bank of Ukraine information on adoption of this resolution.

4. To impose control over the implementation of this resolution on the vice-chairman of the National Bank of Ukraine Alexey Shaban.

5. The resolution becomes effective from the date of, its official publication following behind day.

Regulations on the BankID System of the National Bank of Ukraine

I. General provisions

1. This Provision is developed according to the laws of Ukraine "About the National Bank of Ukraine", "About banks and banking activity", "About electronic identification and electronic confidential services", "About personal data protection" and determines the general principles of functioning of the BankID System of the National Bank of Ukraine (further - the BankID System of the NBU): rules of functioning and use of the BankID System of the NBU, order of interaction and calculations of her subjects of the relations.

The general principles of ensuring smooth functioning of the BankID System of the NBU in the conditions of the special period are determined by the separate decision of Council of the BankID System of the NBU (further - Council).

2. Terms in this Provision are used in such value:

1) the identifying subscriber - bank of Ukraine, the non-bank payment service provider on servicing of the account which is subscriber of the BankID System of the NBU and provides service of electronic identification of the BankID System of the NBU;

2) the subscriber - the service provider - the subscriber of the BankID System of the NBU which with its use obtains from the identifying subscriber data of the user for the purpose of provision to it services;

3) the subscriber - the service provider with the special status - the legal entity with the state pattern of ownership who is the subscriber of the BankID System of the NBU and for ensuring accomplishment of the functions, stipulated by the legislation Ukraine receives from the identifying subscriber with use of the BankID System of the NBU data of the user and transfers to their partner the subscriber service provider with the special status for direct provision of service by it to this user;

4) the subscriber of the BankID System of the NBU (further - the subscriber) - the legal resident person of the private or public law having concluded with the National Bank of Ukraine (further - National Bank) the agreement of accession to the BankID System of the NBU, and National Bank;

5) subscriber node of the BankID System of the NBU (further - subscriber node) - the complex of program technical means established at the subscriber and intended for ensuring exchange of information between subscribers through the BankID System of the NBU;

6) authentication - the electronic procedure which allows the identifying subscriber to confirm the user's personality by provision of service of electronic identification of the BankID System of the NBU;

7) the administrator of subscriber node - the authorized person of the subscriber which is responsible for ensuring functioning of subscriber node;

8) the administrator of the BankID System of the NBU - the employee of National Bank to whom obligations of accomplishment of functions of the administrator of the central node of the BankID System of the NBU are assigned;

9) updating of data processes of obtaining, updating, refining or confirmation of earlier obtained data of the user, performed by the identifying subscriber for the purpose of ensuring completeness, reliability and relevance of such data according to requirements of the legislation of Ukraine in the field of financial monitoring and the documents approved by decisions of Council (further - documents);

10) the questionnaire of the client - the structured set (list) of information (information) about the client which is created, conducted and stored by the identifying subscriber in electronic form with observance of the requirements determined by the legislation of Ukraine in the field of financial monitoring and Documents and is source for filling of electronic confirmation of electronic identification by data of the user which are transferred to the subscriber supplier of services / абоненту-поставщику services with the special status according to requirements of the specification of interaction for the purpose of provision of services to such user;

11) multifactorial authentication - the authentication performed with use at least two factors of authentication each of which belongs to the different categories of factors of authentication, namely: knowledge, ownership, присущесть;

12) verification - the measures taken for the purpose of check (confirmation) of accessory to face of the user of data of the user;
