About labor protection

This Law establishes the legal basis of realization of constitutional rights of citizens on protection of life and health in the course of labor activity and providing single procedure for relations between workers and employers concerning labor protection and is directed to creation of safe working conditions on the workplaces conforming to requirements of preserving life and health of workers in the course of labor activity.

Chapter 1. General provisions

Article 1. The basic concepts applied in this Law

In this Law the following main terms and determinations are applied:

1) safe working conditions - working conditions under which impact on workers of harmful or dangerous production factors is excluded or levels of their impact do not exceed the levels established by standard rates;

2) harmful production factor - production factor which impact can lead to disease or decrease in efficiency of the worker;

3) occupational health - complex of sanitary and hygienic and antiepidemiological measures and means on preserving health of workers, prevention of adverse effects of the production circle and labor process;

4) guarantees of the rights of workers for labor protection - the conditions and means providing to workers complete opportunity to have the rights established by the Constitution, legislative and other regulatory legal acts on labor protection;

5) evaluating professional risks under the terms of work (certification of workplaces) - system of accounting, the analysis and complex assessment on the specific workplace of all factors of the production circle and labor process influencing health and working ability of the person in the course of labor activity for holding improving actions and confirmation or cancellation of the right of provision to the workers of privileges and compensations for harmful and severe conditions of work occupied on them;

6) labor protection - the system of preserving life and health of workers in the course of labor activity including legal, social and economic, organizational and technical, sanitary and hygienic, treatment-and-prophylactic, rehabilitation and other actions;

7) dangerous production factor - production factor which impact can lead to injury, sudden sharp deterioration in health or the death of the worker;

8) public control over labor protection - the supervision of observance of the rights and interests of workers in the field of labor protection performed by labor unions or other representative bodies of workers;

9) occupational disease - the disease caused by impact on the worker of harmful and dangerous production factors;

10) professional risk - the size of probability of violation of health taking into account weight of effects as a result of impact of adverse factors of the production circle and labor process;

11) productive activity - the set of actions of workers using the labor instruments necessary for transformation of resources into finished goods including production and conversion of different types of raw materials, construction, rendering different types of services;

12) industrial injury - any injury of the worker got by him in connection with productive activity irrespective of the place, time and degree of its involvement;

13) production sanitation - system of the sanitary and hygienic organizational actions and technical means preventing or reducing impact by workers of harmful production factors;

14) the worker - the physical person who entered employment relationships with the employer;

15) employer - the physical person or legal entity (organization) which entered employment relationships with the worker. In the cases established by the laws other subject given the right to sign employment contracts can act as the employer;

16) workplace - the place on which the worker shall be or to which it needs to arrive in connection with its work and which directly or indirectly is under control of the employer;

17) special clothes - individual protection equipment, clothes, headdress, mittens, other objects intended for protection of the worker against harmful and (or) dangerous production factors, and also pollution;

18) labor mutilation - the damage of health of the worker owing to accident in case of execution of labor obligations which led to temporary or permanent loss of its working capacity;

19) working conditions - set of factors of the production circle and the labor process exerting impact on working capacity and health of the worker.

Article 2. Legislation of the Kyrgyz Republic on labor protection and sphere of its application

1. The legislation of the Kyrgyz Republic on labor protection is based on the Constitution of the Kyrgyz Republic and consists of the Labor code of the Kyrgyz Republic, this Law and other regulatory legal acts of the Kyrgyz Republic, and also international treaties which became effective according to the legislation of the Kyrgyz Republic.

2. Operation of this Law extends on:

1) employers;

2) the workers consisting with employers in employment relationships;

3) members of the cooperatives participating in the joint productive and other economic activity based on their personal labor participation;

4) students in the educational organizations of the basic and secondary general education, initial, average and higher education, construction, agricultural and other works which are taking place work practice or involved to accomplishment;

5) persons sent to the organizations for the purpose of training or labor rehabilitation after disability not being employees of these organizations;

6) participants of other types of labor activity organized for the benefit of society and the state;

7) the military personnel involved in the organizations;

8) the citizens serving sentence according to the court verdict during their work in the organizations;

9) citizens of the Kyrgyz Republic who work at the companies belonging fully or partially to the foreign legal entities or physical persons located in the territory of the Kyrgyz Republic.
