Chapter 1. General provisions

Article 1. Subject of regulation and coverage of the law

1. This law regulates the organization of processes of development, realization and coordination of policy of mitigation of the consequences of climate change and adaptation to them in the Republic of Armenia, and also the relations between the Republic of Armenia, the governors, communities all by the allocated divisions and physical persons registered in the Republic of Armenia and foreign legal entities in spheres of mitigation of the consequences of climate change and adaptation to them.

Article 2. Legislation on climate

1. The legislation on climate consists of the Constitution of the Republic of Armenia, international treaties of the Republic of Armenia, this law, the law "About Protection of Atmospheric Air" and other legal acts.

Article 3. Purposes and tasks of the law

1. The purpose of this law - to provide the legal basis:

1) for planning and implementation of the actions directed to emission reduction of greenhouse gases according to the international obligations and obligations of the Republic of Armenia;

2) for planning and implementation of measures for adaptation to climate change, including protection of the population, economy and infrastructure against effects of climate change and increase in their stability.

2. Tasks of this law:

1) to create institutional system of development, realization, assessment of results of climatic policy, coordination and accountability of these processes, to fix powers of state bodies and local self-government;

2) to promote forming of steady financial flows for realization of climatic policy by permanent use of the existing and innovative mechanisms;

3) to provide basis for creation and continuous development of system of measurement, accountability and certification according to the expanded framework of transparency provided by the Parisian agreement (further the referred to as Agreement) accepted within the Framework convention of the United Nations on climate change (further the referred to as Convention);

4) to promote capacity-building of the environment, the population, regions, communities, industries of economy and infrastructure for adaptation to effects of climate change and increase in resistance to climate change.

Article 4. The basic concepts used in the law

1. In this Law the following basic concepts are used:

1) climate average condition of weather or the statistical description of average value and variability of the corresponding variables (including observed temperature, rainfall, wind) in the long term;

2) change the climate climatic changes caused by direct or indirect actions of the person during comparable period of time along with natural fluctuations of climate which lead to change of composition of the atmosphere;

3) greenhouse gases - gaseous components of the atmosphere of natural and artificial (anthropogenous) origin (carbon dioxide (CO2), methane (CH4), subnitrogen oxide (N2O), hydrofluorocarbons (GFU), perfluorocarbons (PFU), sulfur hexafluoride (SF6) and trifluoride of nitrogen (NF3)) which absorb and reflect infrared radiation;

4) source of emissions of greenhouse gases - any process, activities or the mechanism which releases greenhouse gas, aerosol or precursors of greenhouse gases into the atmosphere;

5) precursor - chemical compound which, participating in chemical reactions, forms any of greenhouse gases;

6) absorbent - any process, activities or the mechanism which deletes greenhouse gas, aerosol or precursors of greenhouse gases from the atmosphere;

7) vulnerability tendency of the environment, including infrastructure to be exposed to adverse effects of climate change because of their impact, sensitivity or inability to resist or adapt;

8) the losses and damage loss, and damage caused by adverse effects of climate change, including extreme weather events and the slowing-down phenomena, such as sea level rise, temperature increase, salinization, degradation of lands and woods, loss of biodiversity and desertification;
