Rules of tendering (in the form of auction or tender) on right to contract on installation and operation of the advertizing structure on the parcel of land, the building or other real estate which are in the state-owned or municipal property

I. General provisions

1. These rules establish procedure for tendering on right to contract on installation and operation of the advertizing structure on the parcel of land, the building or other real estate which are in the state-owned or municipal property (further respectively - the agreement, the biddings) which are carried out electronically and are open on the list of participants and form of submission of offers.

2. The public authorities, local government bodies specified regarding 5.1 articles 19 of the Federal law "About Advertising" make the decision on tendering and establish tendering form - auction or tender in accordance with the legislation of the Russian Federation (further respectively - auction, tender).

3. The organizer of auction or the organizer of tender are public authorities, local government bodies or the organizations authorized by them (further respectively - the organizer of auction, the organizer of tender).

4. Holding auctions or tenders is provided with the operators of electronic platforms included in the list of operators of electronic platforms approved by the Government of the Russian Federation in accordance with the legislation of the Russian Federation about contractual system in the field of purchases of goods, works, services for ensuring the state and municipal needs (further respectively - electronic platform, the operator of an electronic trading platform).

5. The operator of an electronic trading platform shall provide confidentiality of information on persons who submitted the auction participation application or the bid (further - the applicant), and about the participants of auction or tender which sent information and documents, and contents such information and documents to their direction according to these rules to the organizer of auction or the organizer of tender, smooth functioning of electronic platform and access for the organizer of auction to it or the organizer of tender, applicants and participants of auction or tender during all term of holding the auction or tender and also accomplishment of other functions provided by part 13 of article 17.3 of the Federal law "About Protection of the Competition".

6. The organizer of auction or the organizer of tender has the right to attract as the organizer of auction or the organizer of tender the specialized organization from the list of legal entities approved by the Government of the Russian Federation according to subitem 8.1 of Item 1 of article 6 of the Federal law "About Privatization of the State-owned and Municipal Property" if other is not provided by the Federal Laws (further - the specialized organization), to implementation of functions on the organization and holding auctions or tenders (development of the auction documentation, tender documentation, publication and placement of the notice on holding the auction or tender and other functions connected with ensuring holding the auction or tender). The amount of remuneration of the specialized organization does not enter the price of subject of auction or tender and is subject to payment at the expense of paid over the price of subject of auction or tender of means of the winner of tender or auction or means of person having the right to the conclusion of the agreement following the results of tender or auction, according to the procedure and the size which are established by the Government of the Russian Federation.

7. The specialized organization performs the functions specified in Item 6 of these rules on behalf of the organizer of auction or the organizer of tender and cannot be the participant of auction or tender when whose carrying out the specialized organization performs the functions specified in Item 6 of these rules.

8. Creation of the commission on holding auctions or tenders, determination of the starting (minimum) price of the agreement, subject and essential terms of the contract, the auction documentation, the tender documentation, determination of conditions of auctions or tenders and change of such conditions, and also signing of protocols on results of auctions or about results of tenders and agreements are performed by the organizer of auction or the organizer of tender.

II. Commissions on holding auctions or tenders

9. For holding the auction or tender the auction or tender committee is created.

10. The organizer of auction or the organizer of tender before placement of the notice on holding the auction or tender makes the decision on creation of the relevant commission, determines structure and procedure for its work, appoints the commission chairman.

11. The number of members of auction or tender committee shall make at least 5 people.

12. Person who is personally interested in results of auction or tender or person affiliated with the applicant, including person which is on the staff of the applicant or person on who the applicant is capable to exert impact (including person which is the member of governing body, the applicant's creditor), or the person who is married to the head of the applicant or being the close relative (the relative on the direct ascending and descending line (the parent and the child, the grandfather, the grandmother and the grandson), full and not full (having general the father or mother) the brother and the sister), the adoptive father of the head or the adopted applicant's head cannot be the member of auction or tender committee (if applicant is the legal entity). The member of auction or tender committee shall report without delay to the organizer of auction or the organizer of tender about emergence of the specified circumstances interfering its membership in auction or tender committee. In case of identification of such circumstances the decision on change of structure of the commission is made by the organizer of auction or the organizer of tender no later than one working day from the date of identification of the specified circumstances on the member of auction or tender committee.
