About modification and amendments in some legal acts of the Republic of Kazakhstan concerning the treatment of radioactive waste, power and development of nuclear industry

Article 1. Make changes and additions to the following legal acts of the Republic of Kazakhstan:

1. In the Entrepreneurial code of the Republic of Kazakhstan of October 29, 2015:

Part the second Item 3 of Article 82 to add 1) with the subitem 13) of the following content:

"13) regulation of questions in the field of use of atomic energy, connected including with ensuring nuclear, radiation and nuclear physical safety.";

2) in Article 129:

to add Item 2 after figures "8-1" with figures ", 8-2";

add with Item 8-2 of the following content:

"8-2. Action of this Chapter, except for Items 1, 2 and 3 articles 131, of articles 131-1, 153 and 157 of this Code, do not extend to the state control and supervision in the field of use of atomic energy.";

to add part one of Item 17 and part one of Item 19 after figures "8-1" with figures ", 8-2";

3) in Article 138:

6) to exclude the subitem;

9) to state the subitem in the following edition:

"9) in the field of use of atomic energy;";

to add Item 3 of Article 1 with words ", financings of the projects in the field of use of atomic energy realized within the international treaties ratified by the Republic of Kazakhstan".

4. In the Law of the Republic of Kazakhstan of July 9, 2004 "About power industry":

1) in Article 1:

state subitem 2-3) in the following edition:

"2-3) single purchaser - the legal entity determined by authorized body, performing centralized purchase of service in maintenance of readiness of electric power, service in maintenance of availability of capacity of power networks and centralized rendering service in ensuring readiness of electric power for execution of loading according to the procedure, provided by this Law;";

add with subitems 18-3), 29-2), 29-3), 29-4) and 29-5) of the following content:

"18-3) isolated administrative and territorial unit - the administrative and territorial unit which does not have technical communication (connection) with single electric utility system of the Republic of Kazakhstan which power supply is performed by the power making organizations being in this territory and (or) within the signed purchase and sale agreements of electrical energy with power supply systems of the adjacent states;";

"29-2) service in maintenance of availability of capacity of power networks - the service rendered by the regional electric grid company, the system operator, and also the winner of biddings on construction of power networks to the single purchaser on maintenance of availability of capacity of power networks to acceptance and transfer of electrical energy;

29-3) individual rate for service in maintenance of availability of capacity of power networks - the rate provided by the investment agreement on construction of power networks, including return of the amount of capital expenditures and remunerations on the corresponding loans, profitability rate on the invested capital which is subject to annual indexation on the rate of inflation determined by data of authorized body in the field of the state statistics;

29-4) biddings on construction of power networks - the process directed to selection of the winner for projects implementation on construction of power networks of 220 kV and above, organized and which is carried out in electronic system by the organizer of biddings on construction of power networks within which are determined individual rate for service, amount and term of purchase of service in maintenance of availability of capacity of power networks;

29-5) organizer of biddings on construction of power networks - the legal entity, more than fifty percent of shares (share in the authorized capital) which belong to the state and persons affiliated with it, determined by authorized body;";

31) and 31-6) to state subitems in the following edition:

"31) service in regulation of electric power - the service rendered to the system operator on compensation of variations of the actual electric load of subjects of the wholesale market of electrical energy from the declared electric loading;";

"31-6) markets of electric power - the system of relations between subjects of the wholesale market of electrical energy connected with maintenance by the power making organizations of the generating equipment in ready state to development of electrical energy and maintenance by the power transferring organizations of power networks in availability condition to acceptance and transfer of electrical energy;";

45) to exclude the subitem;

Subitem 1-1) of Article 4 to state 2) in the following edition:

"1-1) performs the state financial support of the single purchaser in case of impossibility of accomplishment of obligations to the power making organizations within the purchase agreement of service in maintenance of readiness of electric power which are power transferring by the organizations within purchase agreements of service in maintenance of availability of capacity of power networks owing to insufficiency of its income from rendering service in ensuring readiness of electric power for execution of loading for compensation for expenses suffered by it by him it is exclusive by provision of this service;";

Article 5 to add 3) with subitem 70-57) of the following content:

"70-57) signs investment agreements on construction of power networks with the regional electric grid companies, the system operator, and also winners of biddings on construction of power networks;";

4) in Item 1 of Article 10:

add with subitem 2-2) of the following content:

"2-2) renders service in maintenance of availability of capacity of power networks;";

state subitems 22-2) and 22-3) in the following edition:

"22-2) confirms deficit and surplus of electrical energy in single electric utility system of the Republic of Kazakhstan according to the procedure, determined by authorized body;

22-3) determines the quota of electrical energy available to activities of digital mayner, according to the procedure, determined by authorized body;";

Item 2 of Article 10-3 to add 5) with subitems 1-1) and 3-1) of the following content:

"1-1) signs purchase agreements of service in maintenance of availability of capacity of power networks;";

"3-1) acquires service in maintenance of availability of capacity of power networks according to the purchase agreement of service in maintenance of availability of capacity of power networks;";

6) in Article 13:

add Item 3 with parts two and the fourth the following content:

"For the purpose of power supply of the consumers who are in the territory of the isolated administrative and territorial unit, the power supplying organizations acquire the electric power at the power making organizations including using renewable energy resources being in the territory of this isolated administrative and territorial unit and also at the suppliers of electrical energy realizing electrical energy in the territory of the Republic of Kazakhstan directly on behalf of the foreign producer.";

"The power supplying organizations performing power supply in the territory of the isolated administrative and territorial unit independently perform settlement of delivery (export) of electrical energy of authorized organization of the adjacent state.";

in Item 3-1:

state part one in the following edition:

"3-1. The power making organizations, except for being in the territory of the isolated administrative and territorial unit, shall perform sale of all amount of the electrical energy released in network, to the single purchaser of electrical energy and (or) consumers entering with them one group of persons or the administrator of hybrid group entering with them into one hybrid group according to this Law.";

add with part two of the following content:

"The power making organizations including using the renewable energy resources which are in the territory of the isolated administrative and territorial unit having the right to implement (to sell) electrical energy of the power supplying organization performing activities within administrative and territorial unit (area) in the territory of which the isolated administrative and territorial unit is located.";

in word part three "to paragraphs to the first and second this Item" shall be replaced with words "to parts one and third this Item";

1) of Item 3-2 to add the subitem with the paragraph the second the following content:

"The power making organizations including using the renewable energy resources which are in the territory of the isolated administrative and territorial unit having the right to implement (to sell) electrical energy of the power supplying organization performing activities within administrative and territorial unit (area) in the territory of which the isolated administrative and territorial unit is located;";

state Item 6 in the following edition:

"6. Subjects of the wholesale market of electrical energy, including all power making organizations irrespective of pattern of ownership, except for subjects of the wholesale market of electrical energy regarding implementation of activities by them in the territory of the isolated administrative and territorial unit, shall participate in the balancing market of electrical energy;";

exclude Item 6-1;

add Item 11 with subitems 3) and 4) of the following content:

"3) sales of electrical energy by the power making organizations which are in the territory of the isolated administrative and territorial unit within the signed purchase and sale agreements of electrical energy with power supply systems of the adjacent states;

4) acquisitions of electrical energy because of limits of the Republic of Kazakhstan for the purpose of delivery of electrical energy to the consumers who are in the territory of the isolated administrative and territorial unit.";

7) in Article 15:

state Item 3 in the following edition:

"3. Functioning of the balancing market of electrical energy is performed according to the procedure, established by authorized body.";

add with item 4 of the following content:

"4. Provisions of this Law regarding functioning of the wholesale market of electrical energy and capacity, including conditions and procedure for purchase and sale of planned amounts of electrical energy, settlement of hourly imbalances, rendering services in the market of electric power do not extend to relations of subjects of the market in the territory of the isolated administrative and territorial unit.";

8) in Article 15-3:
