About the treatment of radioactive waste
In this Law the following basic concepts are used:
1) safety barrier - packaging of radioactive waste, engineering design of Items of storage of radioactive waste, Items of burial of radioactive waste, storages of radioactive waste, tailings dams of radioactive waste or the element of natural geological education interfering distribution of radionuclides and (or) ionizing radiation to the environment;
2) radioactive waste - materials and substances, products and the equipment, and also the breeds, the ores and waste taken from subsoil and warehoused in the dumps and tailings dams containing radionuclides is higher than the level of the withdrawal established by the legislation of the Republic of Kazakhstan which further use is not provided;
3) conditioning of radioactive waste - technological transactions on reduction of radioactive waste in the physical shape and condition corresponding to eligibility criterions of radioactive waste for their burial;
4) burial of radioactive waste (further - burial) - safe placement of radioactive waste in Item of burial of radioactive waste without intention of their subsequent extraction;
5) Item of burial of radioactive waste (further - burial Item) - the subject of the treatment of radioactive waste intended for placement of radioactive waste without intention of their subsequent extraction;
6) eligibility criterions of radioactive waste for their burial (further - eligibility criterions) - the requirements to physical and chemical properties of radioactive waste established for their burial;
7) conversion of radioactive waste - technological transactions on deactivation (release of the deleted radionuclides) and (or) minimization of amount, and (or) change of characteristics of radioactive waste for the subsequent safe handling;
8) storage of radioactive waste (further - storage) - the safe placement of radioactive waste in storage Item, storage or the tailings dam of radioactive waste providing possibility of their subsequent extraction for the further treatment of them;
9) storage of radioactive waste (further - storage) - the subject of the treatment of radioactive waste (including the allocated platform) intended for interim storage during the term established by the project documentation, providing their subsequent extraction for the further treatment of them;
10) Item of storage of radioactive waste (further - storage Item) - the subject of the treatment of radioactive waste intended for temporary placement of radioactive waste during the term established by the project documentation with possibility of their subsequent extraction for the further treatment of them;
11) obrazovatel of radioactive waste - physical persons or legal entities as a result of which activities radioactive waste are formed;
12) the tailings dam of radioactive waste (further - the tailings dam) - the subject of the treatment of radioactive waste intended for long placement of the radioactive waste which is formed in case of conversion of mineral raw materials and mining works (tails and dumps) with possibility of their subsequent extraction for the further treatment of them;
13) the period of potential danger of radioactive waste - period of time during which specific activity of radioactive waste decreases to indicators in case of which radiation control is not required;
14) the treatment of radioactive waste - the types of activity connected with collection, conversion, conditioning, transportation, storage and burial of radioactive waste;
15) the national operator according to the treatment of radioactive waste (further - the national operator) - the legal entity given authority on burial of radioactive waste, and also performing other functions according to this Law;
16) physical protection in the field of the treatment of radioactive waste (further - physical protection) - set of the organizational, engineering and technical measures performed for the purpose of prevention of unauthorized actions concerning radioactive waste and subjects of the treatment of radioactive waste;
17) subjects of the treatment of radioactive waste - special constructions (or complexes) and other engineering designs intended for conversion, conditioning, transportation, storage and (or) burial of radioactive waste;
18) conclusion from operation of subject of the treatment of radioactive waste - stage of lifecycle of subject of the treatment of radioactive waste, except for storages and Items of burial, directed to reduction of object in the condition which is not requiring establishment of restrictions on radiation safety and providing protection of the population and the environment;
19) lifecycle of subject of the treatment of radioactive waste - the sequence of stages of existence of subject of the treatment of radioactive waste including its placement, engineering researches, design, construction, commissioning, operation, conclusion from operation (closing), and also post-operational monitoring and control performed for the purpose of providing nuclear, radiation, nuclear physical and ecological safety;
20) authorized body in the field of the treatment of radioactive waste (further - authorized body) - the central state body performing management in the field of the treatment of radioactive waste;
21) historical radioactive waste - the radioactive waste relating to nuclear heritage, formed till 1992 and not having the owner.

The legislation of the Republic of Kazakhstan in the field of the treatment of radioactive waste is based on the Constitution of the Republic of Kazakhstan, consists of the Ecological code of the Republic of Kazakhstan, the Law of the Republic of Kazakhstan "About use of atomic energy", this Law and other regulatory legal acts, the international contractual commitments of the Republic of Kazakhstan.
