Chapter 1. General provisions

Article 1. Regulation subject

1. This Law governs the public relations in the field of climatic activities and establishes the legal basis of climatic actions for minimization of impact of climate change on the population, economy and ecosystems of the Kyrgyz Republic, ensuring climatic stability and low-carbohydrate development of the Kyrgyz Republic.

2. The law determines the purposes, tasks, the principles and the directions of state policy in the field of climate change, the main requirements to its development, basis for climatic financing, forming and strengthening of monitoring system and assessment, development of research activities, increase in potential, development and transfer of climatic technologies in the Kyrgyz Republic.

Article 2. Basic concepts and determinations

In this Law the following concepts and determinations are used:

1) adaptation potential - capability of systems, organizations, people and other organisms to adapt to potential damage, to use opportunities or to react to effects;

2) adaptation to climate change:

a) in anthropogenous systems - process of adaptation to the existing or expected climate and its impacts to mitigate damage or to seize the profitable opportunities;

b) in natural systems - process of adaptation to the existing climate and its impacts; intervention of the person can promote adaptation to the expected climate and its impacts;

3) impact - effects of the realized risks for natural and anthropogenous systems where risks are result of interaction of the climatic dangerous phenomena, exposure and vulnerability. Impacts mean the effects influencing life, means of livelihood, health and welfare of people, ecosystems and types, economic, social and cultural assets, services (including ecosystem services) and infrastructure. Impacts can be adverse or favorable;

4) emissions of greenhouse gases - release of greenhouse gases and/or their precursors and aerosols in the atmosphere as a result of anthropogenous activities within the preset area and the set period of time;

5) the ESG principles - the basic principles oriented to accounting of ecological (Environmental), social (Social) and managerial (Governance) aspects in activities of the companies and assessment of their stability and impact on the environment, society and internal management structure;

6) climate change - change of condition of climate which can be determined through changes in average values and/or variabilities of its parameters and which remains during the long period usually or is more than decades. Climate change can be caused by natural internal processes or external impacts, such as modulations of solar cycles, eruptions of volcanoes and long anthropogenous changes in composition of the atmosphere or in land use;

7) verification - the independent check of accuracy of the data about reducing or absorption of emissions of greenhouse gases which is carried out by the accredited verification organization;

8) The state emissions inventory and absorption of greenhouse gases - the national information and analytical system intended for systematic collection, accounting, the analysis and data presentation about emissions and absorption of greenhouse gases in the territory of the Kyrgyz Republic, which is official state information resource and integral part of National system of the address of carbon units;

9) categories of sources of emissions - groups of sectors, activities of the person in which lead to emissions or absorption of greenhouse gases: power, industrial processes, agricultural industry, forestry, other types of land use and waste;

10) quota for emissions of greenhouse gases - the allowed level of emissions of greenhouse gases having effective period during which the owner of quota has right to perform the corresponding amount of emissions of greenhouse gases from the objects;

11) state policy in the field of climate change - the state measures and strategy directed to mitigation of the consequences of climate change and adaptation to climate change, strengthening and development of information, scientific, social and economic policy in the field of climate;

12) climatic activities - the actions directed to the decrease in impact of climate changes or adaptation to climate change undertaken by both the state, and private subjects;

13) climatic technologies - the equipment, the equipment, practical knowledge or skills for accomplishment of the climatic activities directed to achievement of carbon neutrality and climatic stability;

14) climatic financing - the local, national or transnational financing from the state, private and alternative sources directed to the support of climatic actions, financial resources intended for adaptation to climate change and the mitigation of the consequences of climate change on a global scale directed to emission reduction of greenhouse gases, decrease in vulnerability, maintenance and increase in resistance of anthropogenous and ecological systems to negative impacts of climate change;

15) the Intergovernmental Panel on Climate Change of RKIK UN - the leading international body according to climate change founded by the United Nations Environmental Program and the World Meteorological Organization, created for risk assessment of the climate change caused by anthropogenous factors, consisting of experts in the field of climate which publishes the periodic estimative reports recognized around the world as the reliable sources of informing existing in the field of climate changes;

16) mitigation (mitigation of the consequences of climate change) - anthropogenous intervention for reducing or prevention of emissions of greenhouse gases and strengthening of absorption of greenhouse gases. Can mean use of new technologies and renewable energy resources, increase in energy efficiency of the old equipment or change of methods of management or behavior of people;

17) inventory count of emissions of greenhouse gases - complex of the actions directed to assessment of emissions of greenhouse gases on sources and absorption on drains for the certain period spent by the authorized state body responsible for development and realization of state policy in the field of climate change;

18) the National System of the Address of Carbon Units (NSACU) - set of the legal, institutional, technical and information mechanisms providing forming, registration, the address, transfer, cancellation and the reporting of carbon units in the territory of the Kyrgyz Republic;
