About entering of amendments into the Law "About Prevention of Violence in Family, Protection of Persons Which Underwent to Violence in Family, and Recovery of Solidarity in Family"

Article 1. No. ZR-320 "About prevention of violence in family, protection of persons which underwent to violence in family, and recovery of solidarity in family" (further - the Law) to add part 1 of article 4 of the Law of December 13, 2017 with Item 9 of the following content:

"9) electronic observation observation of the location, movement and behavior of the person by means of radio waves, biometric, satellite or other electronic means.".

Article 2. In article 7 of the law:

Part 11 to add 1) with new offers of the following content: "When ensuring accomplishment of the decisions on urgent measures of intervention made using the restrictions provided in Items 1, 2 and 3 parts 3 of this Article, police officers can use means of electronic surveillance. The procedure for application and financing of means of electronic surveillance, and also maintaining the database of system of electronic surveillance and use of data is established by the Government.";

To add 2) with part 11.1 following of content:

"11.1. In case of application of electronic surveillance it is necessary to minimize potential negative impact on private and family life of persons. The data obtained as a result of electronic surveillance are liable to destruction within three working days after completion of execution of the decision, except as specified, provided by this part. If the offense is revealed or fixed by means of electronic surveillance, data shall be stored before completion of investigation of offense or completion of formal investigation. The system of electronic surveillance shall have the sufficient level of protection determined by the legislation.".
