About introduction of amendments to the Code of the Kyrgyz Republic about offenses

Article 1.

Bring in the Code of the Kyrgyz Republic about offenses (the newspaper of "Erkin-limited liability partnership" of November 16, 2021 No. 122-133) the following changes:

in Article 65:

a) to state the name of Article in the following edition: "Violation of conditions of carrying out election propaganda, hindrance to carrying out propaganda";

b) add with parts 4 and 5 of the following content:

"4. Hindrance to implementation of the legal election propaganda provided by the electoral laws -

attracts imposing of penalty on physical persons in the amount of 50 settlement indicators.

5. Hindrance to implementation of the legal election propaganda provided by the electoral laws, persons exercising control of condominium, bodies of territorial public self-government or managing company -

attracts imposing of penalty on physical persons in the amount of 50 settlement indicators, on legal entities - 100 settlement indicators.";

c) add with the note of the following content:

"Note. In parts 4 and 5 of this Article to carrying out election propaganda are understood illegal creation of obstacles for access to rooms, objects or the territories for the purpose of carrying out election propaganda as hindrance by methods and according to the procedure, not prohibited by the legislation, or unreasonable refusal in provision of the objects, rooms, areas, surfaces or designs provided in accordance with the established procedure for carrying out election propaganda, or the requirement about the termination of their use, and also intentional creation of other conditions interfering carrying out election propaganda or significantly complicating its carrying out, or assumption of such conditions if such actions do not contain signs of other offenses provided by this Code.".
