About modification of some legal acts of the Kyrgyz Republic concerning gender equality

Article 1.

Bring in the Law of the Kyrgyz Republic "About the state guarantees of the equal rights and equal opportunities for men and women" (Sheets of Jogorku Kenesh of the Kyrgyz Republic, 2008, Art. No. 6/2, 648) the following changes:

1) in Article 1:

a) the thirteenth to state part in the following edition:

"Homework on economy - the work performed by family members, directed to requirements satisfaction of family which is part of family obligations.";

b) the sixteenth to state part in the following edition:

"Indirect gender discrimination - any neutral situation, regulation, measure, the program or practice which is applied to all persons on an equal basis however in practice leads to disproportionately adverse effects for same-gender persons and is not caused by objective and integral requirements of the corresponding work.";

c) the twenty fourth to state part in the following edition:

"Sexual harassment - the gender discrimination expressed in the form of any physical, verbal/nonverbal behavior of the sexual nature and other behavior on the basis of sex affecting advantage of women and men which is undesirable, unreasonable and offensive for them; the refusal of the person of such behavior or subordination to it is used obviously or implicitly as the basis for decision making which influences work of this person; and also behavior which creates frightening, hostile or humiliating working environment for them.";

d) add with parts of the twenty sixth - the twenty eighth the following content:

"Gender violence and sexual harassments - acts of violence on the basis of sex which bring or can lead to physical, sexual, psychological or economic damage or sufferings of women and men, including threats of such acts, coercion or any imprisonment irrespective of whether they are made in public or private life.
