About change of the laws concerning activities of bodies of the State Control Committee

Article 1. Bring in the Law of the Republic of Belarus of July 1, 2010 No. 142-Z "About the State Control Committee of the Republic of Belarus and its territorial authorities" the following changes:

1. In Article 3:

add part one with the words "and other international legal acts containing obligations of the Republic of Belarus";

in word part two of "the agreement of the Republic of Belarus" to replace with the word "agreements";

add Article with part of the following content:

"Features of activities of Department of financial monitoring of the State Control Committee are determined by the Law of the Republic of Belarus of June 30, 2014 No. 165-Z "About measures for prevention of legalization of income gained in the criminal way, financings of terrorist activities and financing of distribution of weapons of mass destruction", by decisions of the President of the Republic of Belarus and other acts of the legislation.".

2. State Article 4 in the following edition:

"Article 4. Principles of activities of the State Control Committee and its territorial authorities

Activities of the State Control Committee and its territorial authorities are performed on the principles:

legality;

observance and protection of interests of the state, the rights and legitimate interests of citizens of the Republic of Belarus, foreign citizens and stateless persons, including individual entrepreneurs (further if other is not determined, - citizens), and the organizations;

unities of system of bodies of the State Control Committee and centralization of management of them;

independence of activities of other state bodies, political parties, other public associations and other organizations, officials;

openness and publicity in that measure in what it does not contradict requirements of the legislation on information, informatization and information security;

presumptions of conscientiousness and innocence of the organizations and citizens concerning whom according to the laws and decisions of the President of the Republic of Belarus control events are held (further if other is not determined, - the checked subjects);

equal rights and legitimate interests of all checked subjects;

prevention of offenses in the economic sphere;

responsibility of the State Control Committee and its territorial authorities (their workers) for violation of the law in case of control.".

3. In Article 6:

"the international organizations" to add part one after words with words ", interstate educations";

in part three of the word "to participate in accordance with the established procedure in meetings" shall be replaced with words "participate in meetings (meetings)";

after part four to add Article with part of the following content:

"Based on the State Control Committee and its territorial authorities the system of public inspectors functions.";

in part five of the word "and international treaties" shall be replaced with words ", the international treaties of the Republic of Belarus and other international legal acts containing obligations".

4. In Article 7:

the fourth to state the paragraph in the following edition:

"implementation of the state control of execution republican and local budgets, budgets of state non-budgetary funds, behind target and effective use by the organizations, individual entrepreneurs of budgetary funds, means of budgets of state non-budgetary funds, effective use of state-owned property;";

in paragraph nine of the word "and financings of terrorist activities" shall be replaced with words "financings of terrorist activities and financing of distribution of weapons of mass destruction";

5. State Article 8 in the following edition:

"Article 8. Functions of the State Control Committee and its territorial authorities

The State Control Committee and its territorial authorities exercise within the competence the state control for:

execution republican and local budgets, budgets of state non-budgetary funds, compliance with law, the governing relation of state-owned property, the economic, financial and tax relations, in case of execution republican and local budgets, budgets of state non-budgetary funds, and also perform in accordance with the established procedure performance reports of the republican budget and budgets of state non-budgetary funds for accounting financial year;

use (expenditure) of budgetary funds for financing of activities of state bodies, other state organizations;

taking measures to debureaucratization of the state apparatus;

execution of the legislation concerning lease, and also privatization and other order objects of state-owned property;

observance by state bodies, other organizations and citizens of the legislation in the field of investments;

use (expenditure) by the organizations and individual entrepreneurs of budgetary funds, means of budgets of state non-budgetary funds, state-owned property, measures of the state support;

legality of use by the organizations and individual entrepreneurs of the material resources acquired at the expense of public funds;

observance by state bodies, banks, non-bank credit and financial organizations, other organizations and individual entrepreneurs of the legislation regulating use of credit and currency means;

observance by the controlling (supervising) bodies of the requirements to implementation of control (supervising) activities established by regulatory legal acts of the President of the Republic of Belarus;

financial and economic activities of state bodies, including diplomatic representations and consular establishments of the Republic of Belarus;

compliance with law in fields of activity with rare-earth metals, precious metals and gemstones;

observance of established procedure of accounting, collection, storage, transportation, use, procurement (purchase), conversion, shipment or realization, export from the Republic of Belarus metal products, ferrous and non-ferrous metals, their scrap and waste;
