In honor of decade of anniversary of Day of National unity and taking into account the principle of humanity of Majlisi namoyandagon of Majlisi Oli of the Republic of Tajikistan adopts this Law.

Article 1. Exempt from custodial sanction, irrespective of the term of the imposed penalty, and also from the punishments which are not connected with imprisonment, the following convicts:

a) women;

b) persons which did not reach eighteen years at the time of crime execution;

c) 55 is more senior than men;

d) disabled people I, II and III groups, and also TB patients;

e) participants of the Great Patriotic War, combatants in the territory of other states and participants of political and military opposition in Tajikistan, also persons who sustained injuries as a result of accident on the Chernobyl nuclear power plant;

e) foreign citizens.

Article 2. Exempt from punishment of persons condemned for making of crimes on imprudence to imprisonment up to ten years inclusive or to the punishment which is not connected with imprisonment.

Article 3. Exempt the following persons condemned to imprisonment for intentional making of crimes:

a) the convicts who for the first time committed crimes of small weight and average weight for up to five years;

b) condemned for the first time for serious crimes if they served at least two thirds of sentence of punishment in places of detention;

c) condemned for the first time for especially serious crimes if they served at least three quarters of sentence of punishment in places of detention.

Article 4. Exempt from punishment of convicts concerning whom punishment is delayed and convicts to whom punishment conditionally is not applied, and also exempted conditionally ahead of schedule or serving sentence in colonies - settlements, and also persons who are condemned to other punishments which are not connected with imprisonment.

Article 5. Terminate the investigation of the following criminal cases which are in inquiry and preliminary inquiry and the criminal cases which are not considered by courts:
