About modification and amendments in the Law "About Military Service and the Status of the Serviceman"

Article 1. Exclude the sixth offer from part 2 of article 33 of the Law of November 15, 2017 No. ZR-195 "About military service and the status of the serviceman" (further - the Law).

Article 2. In Item 7 of part 1 of article 38 of the Law of the word "articles provided by part 7" shall be replaced with words "by results of the certification which is carried out three times in a row in stipulated in Clause procedure without receipt of the right to surcharge or on surcharge calculation continuation".

Article 3. In Article 40, parts 1, Item 3 of the Law of the word "in the case provided in Article 47, of part 7" are shall be replaced with words "in the case provided in Article 38, of part 1, Item 7, if he / she does not agree to appointment to lower military position".

Article 4. State part 3 of article 47 of the law in the following edition:

"3. The serviceman of officer, unter-officer or ordinary structure who signed the new contract for repeated passing of contractual military service according to part 4 of article 33 of this law and appointed to the military position having functions on accomplishment, planning or control of fighting tasks or not having such functions or the serviceman who is holding the military position which does not have functions on accomplishment, planning or control of fighting tasks, and having functions on accomplishment, planning or control of fighting tasks, appointed to military position, the serviceman of the corporal or ordinary structure appointed to military position of officers is subject to obligatory certification not earlier than in two months from the date of assumption of office and no later than day of the expiration of the fourth month by results of which in case of acquisition of right to receipt of the allowance the allowance is estimated from the date of acquisition of right of this right. According to part 6 of article 27 of this Law, the serviceman accepted on military service under the contract is considered qualified based on results of the examinations passed upon termination of the training period if as the contract serviceman he is appointed to the military position corresponding to the military specialty received by it, at the same time the allowance is calculated from the date of appointment to military position. The serviceman of the officer case who graduated from military educational institution of the Republic of Armenia and appointed to officer position according to the procedure, established by this Law, is considered qualified based on results of final examinations of military educational institution, at the same time the allowance is calculated from the date of appointment to military position.".

Article 5. To add part 4 of article 63 of the Law with the new offer of the following content: "In case of the conclusion of the subsequent agreement for a period of two or five years based on expiration of the first signed contract with the serviceman accepted on military service under the contract according to part 6 of article 27 of this Law, the serviceman has the right to remuneration in case of early dismissal from military service under the contract after effective period of the signed subsequent agreement or in case of recognition its unsuitable to military service for health reasons during effective period of the signed subsequent agreement, according to the procedure and in the sizes established by the decision of the Government of the Republic of Armenia.".

Article 6.

1. This law becomes effective for the tenth day after day of official publication.

2. Necessary changes and amendments in the subordinate regulatory legal acts following from this law are accepted within 90 calendar days after the introduction of this law in force.
