About modification and amendments in the Code of civil procedure of the Republic of Armenia

Article 1. To state part 6 of Article 27 of the Code of civil procedure of the Republic of Armenia of February 9, 2018 (further - the code) in the following edition:
"6. In Court of cassation the question of adoption of the cassation appeal to consideration, refusal in adoption of the cassation appeal, leaving of the cassation appeal without consideration is solved by a majority vote from total number of the judges who are present at meeting, and the issue of return of the cassation appeal is resolved only by one judge of civil chamber of Court of cassation, and in anti-corruption chamber - one judge of judicial board on consideration of anti-corruption civil cases. The cassation appeal is considered by a majority vote from total number of judges of civil chamber of Court of cassation, and in anti-corruption chamber - by a majority vote from total number of judges of judicial board on consideration of anti-corruption civil cases.".
Article 2. In article 385 of the code:
1) to state heading in the following edition:
"Article 385. Ensuring execution of the decision and providing claim"
To add 2) with parts 1.1 and 1.2 of the following content:
"1.1. The Appeal Court according to the petition of person participating in case before removal of court resolution by results of appeal cancels measure of providing the requirement if it was applied in the cases connected with dispute on the amount of compensation for property acquisition or process of alienation based on the prevailing public concerns or in the cases connected with aloof or aloof property including the cases connected with registration or dispute on the property right to such property and if the requirement was rejected by the appealed court resolution in the accelerated procedure."
