The purpose of this Law is regulation of the relations in the field of realtor activities.
This Law does not extend to the bargains concluded independently by owners of the real estate which is private property.
The legislation on realtor activities consists of this Law and other acts of the legislation.
If the international treaty of the Republic of Uzbekistan establishes other rules, than those which are stipulated by the legislation the Republic of Uzbekistan about realtor activities are applied rules of the international treaty.
In this Law the following basic concepts are applied:
the real estate agent - the individual entrepreneur or self-employed person performing realtor activities according to the procedure, established by this Law;
multilisting system - the electronic information system allowing to perform transactions with real estate objects by collection, storage and exchange of the available information and offers concerning the real estate market and its objects;
the realtor - the physical person having the qualification certificate of the realtor issued by professional public association in the field of realtor activities;
the qualification certificate of the realtor - the document issued by professional public association, confirming qualification of the realtor and granting the right to rendering realtor services as a part of the realtor organization;
The professional code of ethics of realtors - set of rules of conduct and professional ethics, and also the procedures obligatory for execution by the realtor when implementing realtor activities;
realtor request - the appeal of the realtor organization, the real estate agent to state body or other organizations in written or electronic form, including through multilisting system, with request in accordance with the established procedure to provide information necessary for rendering the corresponding realtor services in the agreement signed with the customer;
the realtor organization - the commercial organization performing realtor activities according to the procedure, established by this Law, and being the member of one of professional public associations in the field of realtor activities;
realtor activities - activities of the realtor organizations and real estate agents rendering realtor services on the basis of the agreement and included in the Unified register of realtors, the realtor organizations, real estate agents and professional public associations in the field of realtor activities.
professional public association in the field of realtor activities (further - professional public association) - the non-state non-profit organization based on membership at least fifty realtor organizations and (or) real estate agents, performing activities for assistance in increase and maintenance of professional level of the members, their support, protection of their professional interests including in courts;
realtor services - the paid services including rendered electronically, provided to the customer of realtor services by the realtor organization or the real estate agent when making the actions connected with real estate objects and the rights to them;
the customer of realtor services (further - the customer) - the legal entity or physical person ordering realtor services by the conclusion of the contract on rendering realtor services with the realtor organization or the real estate agent according to this Law;
The unified register of realtors, the realtor organizations, real estate agents and professional public associations in the field of realtor activities (further - the Unified register) - the unified information system created by authorized state body in the field of realtor activities and posted on its official website, allowing to perform collection, accounting and information analysis about realtors, the realtor organizations, real estate agents and professional public associations.
The basic principles in the field of realtor activities are:
legality;
objectivity and honesty;
confidentiality of information;
non-admission of conflict of interest.
