Confirmation of intention of the parties on implementation of foreign trade activity

The agreement in foreign trade (contract), with all appendices and (or) amendments to it, and in case of lack of the agreement in foreign trade (contract) – other document confirming intentions of the parties

In case of lack of date of effective period of the agreement in foreign trade (contract), with all appendices and (or) amendments to it, and in case of lack of the agreement in foreign trade (contract) – other document, confirming intentions of the parties, it is necessary to provide the confirmation of validity of the contract (agreement) or other document confirming intentions of the parties, expressed in writing, certified by seal and the signature of participants of the transaction (with indication of number and date of the contract (agreement) or other document confirming intentions of the parties);
In the conditions of the agreement in foreign trade (contract) or other document confirming intentions of the parties with the importer (end user) it is necessary to provide Item that the parties if necessary can perform by mutual consent the consultations and other measures directed to confirmation of end use of delivered goods taking into account safety requirements and confidentiality
(it is not required in cases:
- return of earlier imported specific goods to the owner, the seller, the producer;
- export of specific goods for repair, upgrade, conversion, replacement on guarantee of earlier imported specific goods, and also for carrying out demonstration, testing of specific goods.).
When exporting military products in the conditions of the agreement in foreign trade (contract) or other document confirming intentions of the parties with the importer (end user) it is necessary to provide Item on provision of delivery confirmation of specific goods to the end user.

Availability of the obligation of the country receiver about use of products imported from the Republic of Kazakhstan only in stated purposes and non-admission of its re-export or transfer to the third countries without the consent of the Kazakhstan side

The end-user certificate *, the international import certificate or other guarantee document issued by competent authority of the country receiver with indication of:
- names and goods quantities; numbers and dates of the contract in foreign trade (agreement) or other document of alienation;
- the purpose of use of the imported products;
- guarantee of use of the imported products in stated purposes;
- non-admission of re-export of products to the third countries without the consent of authorized body of the Republic of Kazakhstan in the field of control of specific goods.

The end-user certificate, the international import certificate or other guarantee document issued by competent authority of the country receiver is not submitted in cases:
- export of products carried to: Categories 0, Categories 1, 2, 3, 4, 5, 6, 7, 8, 9 (only for group of nuclear suppliers) only for export to nuclear states according to the Nuclear Non-Proliferation Treaty of June 12, 1968;
- return of earlier imported specific goods to the owner, the seller, the producer with provision of supporting documents about import of products to the territory of the Republic of Kazakhstan;
- export of pyrotechnics of civil appointment, and also specific goods in the field of use of atomic energy "The products controlled within homeland security when exporting and importing, which are not covered by categories 0-9" the Control list included in Category 10;
- export of specific goods for repair, upgrade, conversion, replacement on guarantee of earlier imported specific goods, and also for carrying out demonstration and testing of specific goods.
