About entering of amendments and changes into the Code of penal procedure of the Republic of Armenia

Article 1. Article 264 of the Code of penal procedure of the Republic of Armenia of June 30, 2021 (further - the code) to add with part 3.1 following of content:

"3.1. The production provided by Chapter 46 of this Code can be performed according to the written procedure if the court on own initiative or according to the petition of the party came to conclusion that by means of the written procedure it is possible to provide complete, comprehensive and fair treatment of production. About it the court takes out determination and notifies participants of production on the day of removal of court resolution according to the procedure established by this Code.".

Article 2. To state part 6 of article 349 of the code in the following edition:

"6. The chairman signs each page of sentence and signs final part of sentence.".

Article 3. In part 6 of article 350 of the code of the word "not later than within five days" shall be replaced with words "not later than in two weeks".

Article 4. To add part 1 of article 355 of the code with Item 6.1 of the following content:

"6. 1) petition for consideration of the claim in writing, in the presence;".

Article 5. To state part 3 of article 366 of the code in the following edition:

"3. In the absence of the bases specified in parts 1 and 2 of this Article, the claim according to the decision of Appeal Court is accepted to production and is appointed to legal proceedings, and in the case provided by part 3.1 Articles 264 of this Code in the decision it is specified about carrying out consideration of the claim according to the written procedure.".

Article 6. In article 368 of the code:

To add 1) with part 2.1 following of content:

"2.1. The considered criminal case with the decision on purpose of legal proceedings according to the written procedure:

1) it is determined on the date of removal of court resolution;
